Compensation for termination without a valid reason

Hi Anitha

My contract was terminated not for work-related issues on my part and was given the 60 days notice as per the contract.

My question is, does this termination constitute arbitrary termination against the law?

And if this is the case, will I be entitled to a minimum of three months pay?

Dear Questioner,

Thanks for contacting online.

If you have completed one year of service with the company and you were terminated not because of any default on your end with employment-related issues, it is surely an arbitrary termination and you are eligible for a compensation of 3 months salary apart from the notice period salary.

Please feel free to contact me at 0556635526 or WhatsApp me at 0508575526 if you need any further explanation or assistance.

Regards,

Great and thanks, I will be in touch once I collect the relevant documents.

One more question, I worked for a company and post the probation period but within less than a year, they terminated my contact for redundancy and they never paid me the three months compensation, the problem is that I signed the settlement, can I still claim that amount?

You can not claim the benefits after the expiry of one year when it became due.
