Resignation during probation period to take another offer

I have recently come to the UAE on a work permit. My employment visa falls under 4\5 category with an unlimited term.

I was working with the current company last 4 months. Now, I got a new job with a better position and salary. I want to resign from my current job.

Will there be any BAN imposed?

The new offered job requires an attested diploma certificate. I believe I fall in the 2/3 category.

Dear Questioner,

Pursuant to your question (as I understand it), it may be advised that since you are working under an unlimited period of the contract, you may terminate your employment contract on a prior notice of 30 days.

It may be noted that you may leave the employment on a prior notice of 30 days only and that you do not have to pay any compensation to your employer.

Further to this, your current employer may impose a ban on you for failing to complete one year of employment.

However, such a ban may not restrict you from taking up employment with a free zone entity. It would be prudent to seek confirmation on the ban with the Ministry of Labour.

Workers who are under category 4 and 5 are not included in the new ban rule. In case category 4 or 5 labours have not completed the contract with their companies are exempted from this rule and may face a ban up to one year.
