Claim for the end of service benefits upon resignation

Hello Madam,

I am working in a company in Sharjah. I have resigned from my current job for my family problems.

All employees are struggling in my company for the final settlement and even they are not getting any money from the company.

I need my full final settlement, then only I can solve my family issues. I have a credit card balance also here.

Please advise me how to get my final settlement from the company.

Dear Mr A.,

Good afternoon.

Thanks for contacting me online.

Even though you have resigned, you are eligible for the end of service benefits.

If the employer is not giving it to you, you can complain to the Labour through Tasheel and the Ministry of Labour will call the employer to check the chance of settlement.

If it is not settled there, the labour ministry will issue a NOC to you for moving to labour court with your complaint, and the labour court will decide the matter accordingly.

Dear Madam,

Thank you for your answer.

I already resigned and I am in the notice period. I heard if we go to labour court it will take time to clear the issue minimum 4 to 5 months.

I don't have that much time to stay here and I don't have money in hand.

If we go to civil court, will anything happen? or only the labour court?

I am very confused and scared.

This could be through the labour court only. Civil courts will not entertain this and even civil courts take the same time.

Comparatively, the labour court judgments come earlier than civil cases.

Once you get a NOC from the ministry of labour, you can execute a POA in favour of a lawyer or someone to do the needful here on your behalf when you are not here.
