Dear Questioner,

Before proceeding with the eviction, you need to send your tenant a legal notice, requesting him to pay the amount. Otherwise, you can open a case against him.

In case he did not pay the requested amount until the deadline mentioned in the legal notice, you are free to open a case against him.

In case you have postdated cheques issued by him, I suggest you deposit the cheques and if the cheques are rejected for insufficient funds, you can file also a criminal case against him.
