Q: I have issued a cheque as a guarantee to a person who has joined my business as a partner. He did not want to join my license but only a partnership agreement to be signed.
The cheque was issued on an agreement that when the partnership agreement is signed on a later date, he will return the cheque. He did not give my cheque back on the day we signed the partnership agreement.
The business went into a loss and shut down but he is threatening me with the cheque. Can I approach Sharjah police in advance to get my cheque back and avoid police case against me?

Fraud of a company on the final settlement and credit card of an employee

Q: Respected Sir / Madam,
On Mar 2014, my manager was in the process of transferring my visa to the main company.
On his personal guarantee and assurance, he asked me to sign the receipt of AED 34,894/- towards my full and final settlement for the period I worked from August 2007 to March 2014.
Nevertheless, he never made any payment and just assured that he'll pay the same later, saying that the company used my dues for company urgent expenses.
Also between April 2014 to December 2014, and on many occasions, he requested on his personal guarantee and assurance to use my credit card for company official payments. The amount outstanding is AED 13,337/-.
When I started to follow up on my dues, he simply kept dragging and assuring the payment. I begged him many times to clear my dues but he never made any attempt to pay my dues.
He conned, lied and cheated me with my hard earned money, along with the employer.
The company is closed now and we both are working in different companies.
Please advise regarding the legal options to get my dues from him.

Misconduct at the workplace and police complaint

Q: One of the employees was called by our GM to the office for a business review as he is under the performance improvement plan.
He misbehaved during the meeting and was very disrespectful. It reached a level where our GM advised him to leave the laptop and access card followed by HR action.
He further misbehaved and abruptly left the company. He went to the police station and registered a false allegation for abuse and assault.
Thoughts, please.

لقد قامت الشركة بفسخ عقد العمل غير المحدد (فصل تعسفي) في شهر يوليو وأعطي لي شهر إنذار ولكن لم آخذ مستحقاتي منذ ذلك الحين لوجود بناتي على مقاعد الدراسة حتى الآن حتى 11/7/2019 والبحث عن وظيفة أخرى في هذة المدة وإقامتي تنتهي في 11/6/2019.
قامت الشركه بتعيين موظفين آخرين منذ ذلك الوقت. فوجئت باتصال من الشركة يجبرني على إلغاء الإقامة الآن وإلغاء إقامة الأهل والبنات أولاً وأنهم غير مسؤولين عن تكملة البنات لدراستهم.

كنت قد أخذت قرض في الإمارات من مؤسسة مالية قيمته ٤٧٠٠٠ درهم وغادرت الإمارات. أريد أن أذهب إلى السعودية.
هل سيكون هناك منع أو أي ملاحقة هناك لأني أريد أن أسافر للعمل لكي أسدد ديني؟ وللعلم أيضاً، كنت أعمل في السعودية لمدة عام قبل السفر للإمارات.

Termination without notice for making a salary complaint 0
I worked in a company for more than 5 years. I was terminated (with notice period) after I made a salary complaint.
The labour researcher said it might not be arbitrary dismissal because I'm on an unlimited contract, saying any party may terminate the contract as long as there is notice period. So I didn’t push for it.
We haven’t settled my gratuity yet, but they want to deduct my lates and absences. As of now, I'm just assuming they want to deduct all my lates and absences from my joining date until my last day.
I admit that I have many lates and absences (sick leaves) in my entire employment with them, but they never issued any written warning or imposed any fine as disciplinary actions - they didn’t deduct anything on my salary following every incident.
Is it legal for the company to deduct lates and absences on my gratuity?
Can they count the lates and absences from my joining date until my last day?
Or only for the past few months, or 1 year, or start on my latest renewal date?

Notice period for resignation during probation 0
Hi,
I am working in Dubai under an unlimited contract. As per the labour contract, the probation period is 6 months and I resigned from the company in Jan.
The notice period is 3 months from both parties but I am not sure if resigning during the probation requires this notice period of 3 months.
Please advise if they have any right to hold my salary in case I resign and leave the company.

Calculating the last date of work as per the law and contract 0
Good Day Sir/Madam,
I want to ask you as my joining date in my company was 26 June 2015 but they pasted my visa on 9 August 2015.
I checked in “MOHRE” (a government application) that my end of the second contract will be 24 June 2019, but my friends told me it will be according to Emirates ID as 9 August 2019.
Please guide me what will be my last date of work. Will appreciate your reply.
