Q: Good morning, I had two surgeries two years ago. After the first one, I needed to have another one based on lab results. After the second one, I developed severe complications (the doc briefly mentioned it on the consent and I signed it). I was misdiagnosed twice at ER at two different hospitals and was only diagnosed overseas while on holiday. I required surgery, however, it didn’t help and two months later I had another surgery in Dubai. Again it was unsuccessful and I had another surgery two months later. This year I had another surgery. The complication from the original surgery is severe and lifelong and I’m facing so many difficulties. Every doctor I saw after that said they did a very bad job and it’s extremely hard to fix it. Lab results from the original surgery say that all the tissue they removed was healthy and nothing was found. However, the doctor removed a big part and now I’m facing problems. I need an advice if I should file a formal complaint with the authorities. Thank you

Q: Hi, I had a treatment with a machine called HIFU to treat the wrinkles on my forehead, the treatment was so painful, and immediately after, I had 2 large depression on both sides on my forehead and a vertical line in the middle. The company denied their mistake and they are ignoring my calls since the 26th of July 2018. Please note that I was not given any consent form to sign. After consulting a dermatologist, he confirmed that I had an atrophy fat melting and muscle oedema due to this treatment and I have a medical report. I have taken a picture before and immediately after. Kindly let me know what to do. Regards,

س: السلام عليكم، زرت عيادة تجميل بتاريخ 26 مايو 2022 وطلبت من الدكتورة إجراء بسيط. الدكتورة أقنعتني بحقن ثلاث حقن في الوجه ووافقت حسب خبرتها، بعدما انبهرت بالسوشيال ميديا خاصتهم. بعد حوالي 3 أسابيع، ظهر ألم وتكتلات وحدث تشوه وتغيير بشكلي. أخدت موعد وذهبت اليوم التالي عند نفس العيادة وطلبت دكتورة أخرى لأني لم أكن مقتنعة بحقن 3 حقن وطبعًا ما عدت أثق فيها. رفضوا فطلبت تقرير بالمواد التي استخدمت ورفضوا أيضًا. انتظرت الدكتورة لمدة ساعتين وأعطتني كورتيزون. لم أقتنع ولم احتمل شكل وجهي بالتشوه، وذهبت لعيادة أخرى في نفس اليوم وبدأت العلاج لديهم وأخذت تقرير منهم. تواصلت مع العيادة الأولى لاسترداد الأموال وملأت استمارة الشكاوى لحين 07 أغسطس. أرسلوا إيميل بأنهم وافقوا على إجراء التذويب. خلال تلك الفترة الطويلة، كتبت تقييم لهم على جوجل وعلى الإنستغرام ونصحت الناس أن هدفهم تجاري لينتبهوا منهم وشرحت القصة. أمس تواصلوا معي يهددوني بالأمن الإلكتروني وأنهم نسخوا التقييم وسيرفعون قضية. هل يلزمني محامي؟ وهل شرح القصة جريمة؟ وهل يلزمني أن أحذف التقييم؟

س: السلام عليكم، أجريت عملية تصحيح الحاجز الأنفي، ولكن لم يقم الطبيب بالإجراء الصحيح وما زلت أعاني من المشكلة الصحية. للتوضيح أكثر، لم يتم تصحيح الحاجز الأنفي بالشكل الصحيح. كيف يمكن تقديم شكوى وأخذ تعويض؟

Medical treatment provided to patients does not always achieve the desired results, and sometimes it may lead to catastrophic consequences that cannot be remedied. This is due to several factors, some of these factors are related to the therapist or to the patient himself, or even related to God's will. It was, therefore, necessary for the legislator to intervene and develop the laws governing medical malpractice cases and set the limitations of liability for the therapist in such cases.

The provisions of this law, promulgating UAE Civil Code, govern the civil transactions in the United Arab Emirates. The commercial transactions remain subject to the laws and regulations applicable in their regard.

This Law promulgates the Federal Penal Code (Criminal Law) of the United Arab Emirates. Crimes and chastisement punishments shall be determined in accordance with the provisions of this Law and other penal codes.
