Q: Hello! My name is Denis. Can you help with debt issue? There is a company in India. I have bonds $200K stake and $59K unpaid interest. In 2016 may, the company had defaulted on coupon payment. I was reaching the Trustee for this issue, and they told me that I need to have a minimum of 25% of this issue to make any legal action. So, they suggested me to join the group of bondholders, and now, I joined the group to negotiate the debt restructuring. The company hired an advisor. In February 2018, the company and group of bondholders signed RSA agreement and approved restructuring plan. But in April 2018, this RSA was terminated because the company fouled this agreement and did not transfer money (approx. $20 mill) to escrow account till 20 April. Today is total silence. In prospectus the company have a branch in the UAE, is it may be possible to somehow collect the debt? Thank you for your help.

Q: Hi, I obtained a degree from a US-based university based on experience 10 years ago, however, I noticed after receiving it that it was fake, so I didn't process any attestation or submission to any of the authorities in the UAE. I received a call from the US embassy 3 weeks ago inquiring about it and that the said university has legal cases already, so they put me in contact with the so-called United States higher learning education. They mentioned that they will need to get NOC's to remove my name from the US system that I have a degree and they asked me to wire transfer of $2500. Also, I received a call from the Ministry of Foreign Affairs and it was an Arabic lady stating that I need to finish this issue with them otherwise it will be sent to the UAE Justice Department. Hope to receive advice.

Q: I was persuaded by my friend to put money in an online trading, and he will trade on my behalf and will share the profits. He guaranteed me that he will trade very carefully and the principal amount will not decrease, but he lost all the money in one night which is AED 35000. Then he gave me 6 cheques of 5000 each payable after every third month. Kindly advise how to proceed as he is not ready to pay now.

س: تم الاتفاق مع شركة إسبانية على توريد عدد من الأجهزة الطبية وتم سداد قيمة الأجهزة بالكامل بناء على أمر شراء وتحويل بنكي إلى حساب الشركة بمملكة إسبانيا. لم أستلم الأجهزة! علمًا بأنه تم مراسلة الشركة عدة مرات وفي كل مرة يتحججون بأن المواد الخام هي سبب التأخير، ثم يتحججون بوباء الكورونا. ما الحل الذي أستطيع القيام به لاسترجاع أموالي؟ علمًا بأنه تم سداد مبلغ 36 ألف يورو والشركة خارج الدولة وليس لها أي مقر أو مركز إدارة أو خلافه داخل دولة الإمارات.

س: كيف يتم إعلان التكليف بالوفاء ضد شركة موجودة خارج الدولة (إسبانيا)؟ وما جهة الاختصاص القضائي في الدولة في حال عدم ذكر ذلك في الاتفاقية أو العقد المُبرَم بين الشركتين؟ وهل المبلغ الواجب ذكره في تكليف الوفاء يشترط أن يكون بالدرهم الإماراتي أم بالعملة التي تم التعامل بها؟ وما اللغة الواجب استخدامها في الإعلان: العربية أم الإسبانية أم الإنجليزية؟

س: إذا أُبرِم عقد عرفي معي باسم مؤسسة أو شركة والشخص الذي مثّلها أثبت أهليته للتعاقُد بموجب جواز سفره واتضح أن هذه المؤسسة أو الشركة لا وجود قانوني لها، فهل يمكن إلزامه شخصيًا بالمستحقات المترتبة على العقد؟ وما الإسناد على ذلك من الأحكام السابقة في دولة الإمارات؟ شكرًا!

This Law promulgates the Federal Penal Code (Criminal Law) of the United Arab Emirates. Crimes and chastisement punishments shall be determined in accordance with the provisions of this Law and other penal codes.

The provisions of this law On Evidence in Civil and Commercial Transactions (Law of Evidence) govern evidence in civil and commercial disputes in the UAE.
