Q: Does article 120 of Labor Law in case of termination by employer cover the following situation: An employee went on an emergency leave due to his Mother's hospitalization and after 45 days she passed away. When he came back to Dubai, his employer refused to pay the final settlement and forced him for cancellation.

Q: An employee (driver) in my company failed to report to work on the agreed date after his leave days, then the director had to hire a driver for two days. The employee never reported to work until now but the company had to pay to his account salary for two months. Now, the driver went to a lawyer and they are requesting severance fee, illegal termination fee and salary in lieu of notice. How is all this possible and yet the employee was not fired and he never called back? Kindly help

Q: Hi, I was terminated from my current job in Nakheel PJSC on 19-6-18. In the termination letter, they mentioned the reason as "dismissed without notice for Gross Misconduct in accordance with employee regulations manual (Chapter C - Section 23) and as per UAE Labor Law Article 120" with immediate effects. They also said verbally that the company will not pay me my end of service benefit amount. My question is, can the company hold this amount? Can I claim it legally from the company? Please advise. Q: One of my employees requested 3 months annual leave, we granted 2 months. However, once he went on leave, he came back after 5 months. We gave him a show cause notice, he said he is not willing to give us a written explanation for his absence. How do I proceed with him now?

Q: My company terminated me based on articles 82,83,84 & 85 after I got a stroke in November 2019 when I was on duty and the company took me to hospital. My GM also visited me home saying that no need to submit sick leave as it will cost you every time. Once you're fine come to work. They forcefully took signature on annual leave after one month of my sickness. I was paralyzed from one side and was not in a condition to travel, still, the company issued me a ticket part of the annual leave. Now, they have terminated me and did not pay the salary to me since January 2020 nor are they paying my physiotherapy bills. They didn't even give me any notice period before termination. Please advise what can I do. I have even filed a labour complaint but it's of no use. I am a driver by profession. Please contact me. Thank you
