New company's withdrawal of a job offer after resigning from the old company

I need your suggestion and advice regarding my case.

I was working in Abu Dhabi and I got an interview call from Dubai. I attended two interviews and I was selected, then I received an offer letter.

Based on that, I resigned from my job and served a one-month notice period. I joined the new company and after eleven days they refused to offer me the job.

Now, I don't know what can I do. I lost my previous job because of them.

I want to know what legal rights I have, and what legal action I can take against the new company.

Dear Questioner,

You may direct your complaint to the Ministry of Human Resources through the Tasheel program.

Even if you did not finalize your employment visa procedures with the new company, you still have the right to appear before the labour court.

You may file your complaint based on the offer letter and claim compensation for such severe damages that occurred to you based on the company's decision of withdrawing your offer letter.

According to the new UAE labour law, the employer has to present a standard offer letter, (which needs to be signed by the employee), to the Ministry of Labour UAE (MOL) in order to apply for an entry permit for the employment visa.

You may have a valid claim against the employer who offered you employment and later revoked the same.

Normally all cases pertaining to employment are before UAE labour department, however, since you still do not have a MOL contract you cannot file a case before MOL.

You need to file a case before the UAE court for breach of the offer letter.

You must keep in mind that an offer of employment may be treated as a contract IF both the employer and the employee have duly signed the same.
