Q: Dear Sir, I have credit cards and loan from 2 banks, almost AED 85k. Suddenly, my company is not able to pay the salaries & the last few months we are getting the salary after 50 days. I am managing my credit card by minimum payments but wouldn't be able to make payment of AED 59k loan now (paid 8 instalments). Now, I am receiving calls from the banks. The banks where I took loans have my cheques. What will happen now if the banks present my cheques & bounced? It's very difficult for me to settle.

س: السلام عليكم أخذت قرض بقيمة 100 ألف درهم إماراتي في يونيو الماضي 2018 بنظام سداد 2757 درهم شهريا لمدة 48 شهر. للأسف، بعدها بشهرين تم فصلي من عملي وإعادتي إلى بلدي ولم أعطَ حتى فرصة البحث عن عمل حيث أن جوازي وهويتي كانا مع إدارة الموارد البشرية لصاحب العمل. المهم استمريت في دفع الأقساط وعملت توكيل لأحدهم لعمل سداد مبكر. البنك يطالبني بدفع 80 ألف درهم، علماً أن المستحق هو الأصل وفوائد السنة الاولى أي حوالي 108 آلاف درهم إماراتي. سؤالي هو: 1- لدي أسرة بالإمارات. هل يمكن أن يتأذوا في عملهم أو أن يمثلوا للقضاء إن تخلفت عن دفع ما يزيد عن 108 آلاف وهي القيمة الفعلية التي ينبغي علي دفعها (الأصل وسنة فوائد)؟ 2- ما هي العقوبة القانونية إن لم أدفع سوى المبلغ المذكور آلاف وهي القيمة الفعلية التي ينبغي علي دفعها (الأصل وسنة فوائد) وتخلفت عن باقي المبلغ المطلوب؟

Q: I have a case filed against me by the bank last month end for failing to pay 2 EMIs. I have been unemployed since April 2017 and have managed to pay my EMIs from the settlement I received from my previous company and some other EMIs by borrowing money from friends and families. I have not been able to find suitable employment during this time and I have AED 52000 to pay the bank (the original amount being AED 254,000). Please advise on the next possible actions.

س: السلام عليكم، تركت وظيفتي في فبراير 2019 وانضممت إلى شركة جديدة في نفس الشهر. كان لدي، في ذلك الوقت، قرض من بنك لسيارتي بدين مستحق يبلغ حوالي 15000 درهم. أبلغ عملي القديم البنك بأنني تركتهم. وعلى ذلك قرر البنك، دون إخطاري، حجب كامل مبلغ استحقاقات نهاية الخدمة عن وظيفتي القديمة على الرغم من: 1) دفع جميع دفعات القرض عن السنوات الأربع الأخيرة بالكامل وفي الوقت المحدد للدفع. 2) إيداع راتب وظيفتي الجديدة في حسابي مع البنك. بعد التحدُّث مع البنك وتقديم شكوى لديهم، فكوا جزءًا من المبلغ ولكن حجبوا 10000 درهم. وهم ينقصون المبلغ المحجوب شهريًا. واليوم لا يزالون يحتجزون 5000 درهم. لا تنص مستندات القرض التي وقعتها على أن البنك له الحق في حجب أي مبالغ في حالة فقد أو تغيير وظيفتي، ومع ذلك، أبلغني موظفو البنك بأنها "سياسة البنك" (Bank Policy). ورفضوا مشاركة هذه السياسة معي. هل يمكنني الإبلاغ عن البنك لخيانته للأمانة؟ حيث أنني أودعت راتبي وأموالي لدى البنك والبنك اعتدى عليها بدون حق.

س: السلام عليكم، بالنسبة إلى شيكات القروض والكردت، رغم سداد جزء كبير من المبلغ المدون في الشيك للموافقة على القرض ومعروف أن الشيك يكون بالمبلغ والفوائد والمصروفات، فما السند لحماية المقترض أو حامل الكردت؟

The management of individual financial affairs is crucial and all the actions must be weighed down while committing to any financial liability. Whether it's job loss that may have lead to financial failure or the opposite, one must be aware of the personal liability which will not diminish by paying fines for cheque bounce cases. There are two major types of liabilities, criminal liability and civil liability. Each has its own significance, hence, must be dealt with accordingly.

This Law applies to merchants, as well as to all acts of commerce carried out in the UAE by any person even though he be not a trader. Commercial matters regarding which specific Federal laws are issued shall be subject to the provisions of such laws, and to the provisions hereof which do not contradict with said laws.

The provisions of this law, promulgating UAE Civil Code, govern the civil transactions in the United Arab Emirates. The commercial transactions remain subject to the laws and regulations applicable in their regard.

This Law promulgates the Federal Penal Code (Criminal Law) of the United Arab Emirates. Crimes and chastisement punishments shall be determined in accordance with the provisions of this Law and other penal codes.
