Termination of tenancy upon expiry of the rental period
Q: I want to vacate my flat when the contract expired. I have a flat in Dubai, I rented the flat last year in August through estate Agent, as I am not living in UAE but in the UK. I am not familiar with the real estate Law in UAE if I intend to give notification to the tenant to vacate the Flat in August when the contract expired. But Tenant informed me that they will not leave, and they have the right to stay 2 years! And they've gone deal with RERA regulations! The tenant was giving several times wrong cheque... Have really the tenant such right and what about the Landlord? Thanks.

The tenant's rights in case of selling the rented property
Q: Hi, We just moved into the apartment (just over a month) and now the landlord says that he had put up the property for sale and rent since 8 months ago, which we were not notified of by both the agent and the landlord. Considering we had plans to stay for long-term, we have had spent a significant amount on the furniture and the interiors. Now, I have been getting calls for viewings, so please help me understand: 1) Can I prohibit the access of the landlord for the viewing? 2) Can I withdraw from the contract and claim all my expenses after deducting for the days stayed, including the agent fees?

Is the tenant obliged to leave the property after selling it to another owner?
Q: Hi there, I am renting a property with the contract expiring on Oct 1, 2022. Apparently, the property was sold and so far I have not received any official information. As far as I was able to understand, according to Dubai law, I will be entitled to stay in the property for 1 calendar year from the day I will be formally informed that the property has been sold. Is this correct?

The new landlord asks the tenant to pay for a new Empower registration that exists already
Q: I am a tenant in Discovery Garden and my landlord registered the Empower in his name and took AED 2000 for registration. Now he has sold the flat and not returning the Empower registration amount. The new owner was not aware of this and when he came to know he registered the same and asked me to register as a tenant plus pay AED 2000, while the due date to register the amount is passed. I told him I will not pay another AED 2000 until I get the same from the previous owner. Now I am stuck between the new owner and the old one.

Can I renew the current contract as the new landlord or is a new one needed?
Q: Good afternoon, I bought a tenanted property a few months ago. The tenancy contract will expire at the end of January. I would like to renew the contract with the tenant under the same conditions. Do I have to sign a new contract with the tenant, or can I simply renew the current contract by changing the name of the landlord? Thank you for your advice!

The provisions of this Law apply to real property leased out in the Emirate of Dubai, including vacant and agricultural lands, but excluding hotel establishments and real property provided by natural or legal persons as accommodation to their employees at no charge.

How can I vacate my tenant if the rental agreement ends before the eviction notice deadline?
My Dubai tenant's rental agreement is ending by the end of September 2024 and the completion of 12 months of legally served Eviction Notice is the end of December 2024. I have two questions: (a) Can I send a rent increase notice 3 months before as the rent has increased as per the RERA rent calculator? (b) The second question is, do I have to renew the rental agreement for 3 months (until December 2024) or not? Thank you.

How can I reach a settlement with the bank for a mortgage of a jointly owned property?
I have a jointly owned property in Abu Dhabi. The mortgage was defaulted on as I had to leave the property with my children following an assault by my ex-husband. He left the country in 2018 and never paid the mortgage. As I was in the country, the bank filed a criminal case against me, and I was sentenced to 3 years. I won the appeal against the bank and then filed another criminal case a few months later in Dubai. Again, I won and paid a fine. In 2019, the bank started a civil case against me and my ex-husband to have the property repossessed. However, at the time of the purchase of the property, there were no Title Deeds, the bank requires this. I cannot give them the Title Deeds to sell the property and pay back the amount owed to them as my ex-husband refuses to provide a POA. The bank has filed another criminal case against me only for our jointly owned property. I wish to resolve this and pay off the bank and receive any money left from the sale. How can I resolve this issue of the Title Deeds?

Can a real estate agency hold a percentage of a property sale until transfer is done?
A real estate agency has signed an MOU stating that a 10% security deposit from the buyer and the seller will be kept in the real estate agency and will be released upon transferring the property. The transfer of the property was blocked due to the court order. According to my colleagues, the real estate agency is not a trustee and they are not allowed to have taken my security check in the first place, is this correct?
