Is an eviction notice sent by email only considered valid by the RDC?

Hello,

The landlord sent a legal notarized eviction notice for personal use via Aramex to our email only.

Will the RDC approve the eviction, or is serving the notice by email only not a valid method?

Be advised that under Dubai Law No. 33 of 2008, a landlord seeking eviction for personal use must serve the tenant with a written notarized notice at least 12 months prior to eviction, and it must be delivered through the notary public or by registered mail (courier delivery with acknowledgment).

Serving the notice via email alone is generally not considered a valid legal method unless the tenant expressly accepted electronic communication as an official mode of notice in the tenancy agreement.

Therefore, unless proper service through the notary or registered courier can be proven, the RDC is unlikely to accept email-only service as valid grounds for eviction.

The law requires that the notice be notarized by the notary public at least 90 days before the contract’s expiration.

It does not matter whether it is sent by email, WhatsApp, or SMS, as long as it is officially notarized. However, you still have the right to appeal.
