How can I recover my refund from a visa service company that failed to process my work permit?

Hello,

I have been trying to get my refund from an immigration visa service company for months now. The company promised a refund for a Europe work permit application that they never completed.

Despite multiple follow-ups, I have not yet received my money back. I have all the receipts, emails, and WhatsApp messages as proof. The amount is less than AED 5,000; however, it is a big deal to me.

Please advise!

Hello dear,

You can apply via the Dubai Police app if you're in Dubai, or the Ministry of Interior app if you're in another emirate. You can file a complaint online against the company, providing receipts and emails.

Thank you for reaching out and sharing your concern!

Based on what you described, since the company failed to deliver the promised visa/work permit and you have clear proof of payment and communication, you are legally entitled to recover your amount.

For a claim below AED 5,000, we can proceed efficiently through the Small Claims Tribunal (SCT) at Dubai Courts or the Dubai International Financial Centre (DIFC) Small Claims Tribunal, depending on where the company operates.

Both forums are fast and cost-effective, and in many cases, clients get their refund orders within weeks.

I can assist you in preparing the complaint, compiling your evidence (WhatsApp, receipts, and emails), and representing you through the entire recovery process.

Let’s discuss the details and choose the quickest route to recover your funds. Please contact me directly on [-------------] (WhatsApp or call) so I can review your documents and start your refund claim immediately.

Dear questioner,

You can file a consumer complaint with the DED in the emirate where the consultancy is registered or located, and request a refund in the complaint.

Dear Questioner,

Thank you for reaching out regarding your refund issue!

Based on your explanation, since the company failed to fulfill their obligation to process your Europe work permit and has not refunded your payment despite multiple follow-ups, you have legal grounds to pursue recovery of your funds under UAE Federal Decree-Law No. 5 of 1985 on the Civil Transactions Law.

Specifically, this law provides that if a service provider fails to perform the agreed service, the client is entitled to claim a refund or compensation for breach of contract.

You have three options available:

1. Send a Demand Letter

A formal demand can be issued to the company requesting immediate payment within a specified period. This often prompts resolution without legal escalation.

2. Issue a Legal Notice

If they fail to respond to the demand letter, a legal notice can be sent through a registered lawyer, serving as an official warning before filing a case. This shows your intent to pursue legal action and increases pressure on the company to settle.

3. File a Civil Claim

If the company still refuses to pay, you can file a civil claim before the Small Claims Tribunal of the Dubai Courts (or the relevant Emirate’s court). For an amount below AED 5000, the process is relatively straightforward and handled under simplified procedures.

If you find it difficult to manage the process on your own, we can assist you with the complete procedure from drafting and sending the legal documents to filing the claim and following up with the authorities until the matter is resolved.

Please let me know if you wish to proceed with our assistance so we can begin preparing the necessary documents.

Kind regards,

Mohammad Salah
