I filed a case for my unpaid salary and gratuity and a final decision has been released. How to enforce it?

Good day!

I just want to seek advice regarding my unpaid salary and gratuity. Actually, I already filed a case in MOHRE, and they released a final decision.

However, until now, my previous company has refused to give me my last salary and gratuity, and they are not even replying to my messages and emails.

What should I do?

Thank you.

A file must be opened to enforce the decision against the company.

Hi,

Thank you for reaching out.

Since you have already received a final decision from MOHRE and your previous employer is still refusing to pay your salary and end-of-service benefits, the next step would be to escalate the matter to the UAE Labour Court.

You can request a referral letter from MOHRE to initiate the court process.

Once the court issues a judgment in your favor, and if the employer still fails to comply, you can proceed with enforcement through the Execution Court, which has the authority to freeze company accounts, seize assets, or impose travel bans.

Please ensure you retain all relevant documents, including the MOHRE decision, your employment contract, and any communication with your employer.

Should you need assistance with filing or enforcement, we’d be happy to support you through a detailed consultation.

Best regards,

Now that you have received a final decision from the Ministry of Human Resources and Emiratisation, and the company is refusing to pay, you can now take the following steps:

1) Ask the ministry to assist you in implementing the decision.

2) If you are unsuccessful, you can file a lawsuit against the company in the labor court.

3) Make sure to save all correspondence and documents related to your case.

Contact me on the phone to file a lawsuit.

Hello

If you have already filed a case, then you need to follow up. Also, if there is judgment and if it is executed, then take measures like a travel ban, account seizure, and blocking the trade license.

If you need more details, kindly share your WhatsApp number.

Dear Sir,

Since MOHRE has issued a final decision in your favor, you can enforce this decision through the competent court or enforcement authorities to compel your former employer to pay your unpaid salary and gratuity.

You may file an execution case based on MOHRE’s ruling if the employer continues to refuse payment.

Please continue to follow up with MOHRE, and if needed, I can assist you with filing the enforcement case and providing legal support.

Best regards.
