نظرة في الطعن 4 لسنة 2023 قرارات الهيئة العامة لمحكمة تمييز دبي

بتاريخ 24/10/2023، صدر قرار الهيئة العامة لمحكمة تمييز دبي في الطعن 4 لسنة 2023 مرسياً مبدأً جديداً مفاده أن الأصل في الناس هو الإعسار وأن اليسار عارض، وأنه يتعين -تبعاً لذلك- على طالب التنفيذ أن يثبت يسار خصمه المنفذ ضده أو تهريبه لأمواله كي يستصدر أمراً بضبطه وإحضاره ثم حبسه لإكراهه بدنياً على السداد. وكما هو متوقع، أحدث هذا القرار ردود فعل كثيرة ومتنوعة، سيما وأنه قرار نوعي يقلب كثيراً من الأوضاع المعتادة رأساً على عقب ويغير من الحالة الاجتماعية السائدة الشيء الكثير.

لقد كانت مجلة الإجراءات المدنية لسنة 1910 تعتمد النظام الاستقرائي، إذ أنها أوكلت على القاضي القيام بالإجراءات؛ فدوره شبيه بدور حاكم التحقيق في المادة الجزائية. لكن مجلة المرافعات المدنية والتجارية لسنة 1959 اعتمدت النظام الادعائي الذي يترك للخصوم أمر تحقيق الدعوى فقضى الفصل 12 منها بعد تنقيحه سنة 1980 " ليس على المحكمة تكوين أو إتمام أو إحضار حجج الخصوم". ويستوجب النظر في هذا النص تحديد دلالة حجج الخصوم قبل بيان دور المحكمة في الاثبات المدني.

الإعسار في القانون الإماراتي

الشرط الجزائي في العقد المدني من خلال مجلة الالتزامات والعقود

رأي في القرار التعقيبي عدد 1350 الصادر عن الدوائر المجتمعة في 2002

أصدرت محكمة التعقيب بدوائرها المجتمعة القرار التعقيبي المدني عدد 1350 بتاريخ 25/04/2002 قاضياً بنقض الحكم المطعون فيه وإحالة القضية إلى محكمة الاستئنناف لإعادة النظر فيها بهيئة أخرى. وقد نشر هذا القرار بمجلة القضاء والتشريع (العدد 10، ديسمبر 2005 ص 285 وما بعدها) مع ملاحظات الأستاذ التيجاني عبيد.
