Can the landlord increase rent according to the valuation certificate?
Q: Hello Everyone, I know it has been discussed quite a few times; however, it`s not clear. Can the landlord increase rent according to the valuation certificate? My current rent is AED 71,400. When I check the RERA Rental Index, below is the text being shown: When renewing real property lease contracts, the maximum percentage of rent increase for real property in the Emirate of Dubai is 5% of the rent of real property unit, where the rent is 11% to 20% less than the average rental value of similar units. The rent for a two-bedroom apartment in Port Saeed ranges from 72,000 to 88,000 AED per year (excluding water, electricity, or any other fees). The increase amounts to 3,570 AED per year. The landlord`s valuation certificate states AED 85,000. Therefore, my question is whether the rent can be raised to AED 85,000 using the valuation certificate, or if the increase should be limited to 5% since the valuation falls between 11-20%.

Q: Dear Sir/Madam, An eviction notice was served to the tenant by the old owner in June 2023. The apartment was sold in March 2024, with the tenancy contract limited by the notice passed on to the new owner. The date of eviction is now approaching. Is there a risk that a new eviction notice is required since the owner`s name changed and the tenant might not respect the old one?

Can I sue for damages due to the landlord's maintenance negligence?
Q: Dear Sir/Madam, I rented a unit through an agency leasing on behalf of the landlord, and I don’t have the landlord’s contact details. Two months ago, I noticed a leak in the unit and reported it to the agency via their portal. Despite this, I received no response. I also sent emails, and the only reply I received was that they are waiting for the landlord’s approval to fix the leak. Moved into a new apartment with incomplete maintenance and Tawtheeq. What to do?
Q: Hello, We recently moved into a new apartment on the first of this month. Upon arrival, we discovered that maintenance had not been completed, and the Tawtheeq had not been changed to our name. When we inquired with the agent, they explained that the previous tenant`s contract did not end until the 8th of this month, and they had not terminated the contract. As a result, we are currently without power, water, and unable to register for AC. We are concerned about potential liability, as it seems we may have moved in illegally before the previous tenant`s contract ended. What should we do in this situation, and are we liable for anything regarding our move-in? Our contract states it begins on the 31st of May, and we have paid all fees to the agent and owner.

Am I obliged to accept the 25% judgment of my labor dues offered by the court liquidator?
Q: Hi Sir/Madam, My case is a labor case under execution enforcement in a group case for 2 years. Yesterday, I heard from my friends the court liquidator committee they are listing the employee for settlement. When I went, I found they were asking me to accept 25% of the judgment or leave it. Can I claim compensation from my previous landlord for vacating me to increase the rent?
Q: My landlord evicted me after sending me a court notice that he intends to sell the property. I even told him that if this is just about increasing the rent, I would be happy to do that since my wife is undergoing cancer treatment and moving is difficult for us. Nonetheless, he asked us to vacate and is now renting the apartment out (but there does not seem to be any Ejari registered). What to do after being caught with a small amount of weed and released with a case number?
Q: Dear Sir/Madam, My friends and I were caught at home by the CID with a small amount of weed after one of my friends deposited funds in an account to purchase cannabis at the end of 2023. We all tested positive at the CID headquarters, admitted that we had it for personal use, and were transferred to a police station. I bought a second-hand car with hidden defects and the dealer failed to fix it. What can I do?
Q: Hi Sir, I bought a second-hand car from a reputed dealer in Dubai On April 18, 2024. After four days of ownership, I realized the car was jittering/vibrating/ hesitating to maintain at a particular speed. I immediately informed the car dealer and they promised to fix it the first time but when I got the car after rectifying and repairing it, it had the same issue. Again I informed the car dealer about it and they took the car again for a spark plug change and took three and a half days to repair it. Once I got the car back I realized the same issue was still there. Now for the third time, I informed them and they are asking me to come again for repair/inspection purposes. I asked them to share the pre-inspection report as they claim they have a 150-point check-up but they have not shared the report to date. The car is under warranty for a year. Is it normal for a company to require an initial payment for visa and work permit?
Q: Sir/Madam, I am currently in India and have received an offer letter from a company based in Fujairah, UAE. They have asked me to contact a travel agency for the work permit and visa process. The rental agreement and Ejari have expired. Is the tenant occupying illegally?
Q: Dear Sir/Madam, I have just purchased a property with a tenant inside. It turns out that the rental agreement and Ejari expired in March 2024 (2 months ago). Is the tenant, therefore, occupying illegally? What are my options to get the tenant out?
