How to get my labor judgement payment released if it has already been paid to the court?

I have an ongoing labor case which is currently in the execution phase and the court has already received the pending amount.

The final judgment came on May 3rd, so I want to understand when can I expect to get the amount and how long I am eligible to stay in UAE.

I am still on my employer's visa. What if I cancel the visa, is there any grace period in this situation or that would have been exhausted by now?

Yes, you have a grace period after canceling the visa, which is 60 days from the date of cancellation.

Greetings.

Have you attached your IBAN to the execution file?

The amount will not be delayed after the execution is completed, especially if you request reserve requests to seize the company's accounts and cars.

You have two months to adjust your situation from the date of cancellation of your visa.

For further inquiries about your topic, you can reach our office or contact us on WhatsApp.

The timeframe for receiving your awarded amount can vary depending on several factors, including court workload, and bank transfer processing time.

Generally, it can take anywhere between a few weeks to a few months for the court to finalize the disbursement process and transfer the funds to you. You can check with the court as well.

After the employer-sponsored visa cancellation, Dubai allows a grace period from 30 days to 6 months. You may check with MOHRE.

Receiving the Pending Amount from a Labor Case in the UAE:

In the UAE, once a court has issued a final judgment in a labor case and the pending amount has been received by the court, the process of disbursing the funds to the rightful party typically begins.

The timeline for receiving the amount can vary depending on various factors such as administrative procedures, court workload, and banking processes.

Expected Timeline for Receiving the Amount:

The duration it takes for you to receive the pending amount from your labor case after the court has received it can vary.

In general, it may take several weeks to a few months for the funds to be processed and transferred to you.

It is advisable to stay in touch with your legal representative or contact the relevant court or authorities handling your case for updates on the disbursement process.

Eligibility to Stay in the UAE After Receiving Settlement:

As long as you are on your employer’s visa and your residency permit is valid, you are eligible to stay in the UAE.

However, if you wish to cancel your visa and leave the country after receiving the settlement amount, there are certain considerations to keep in mind.

Grace Period Upon Visa Cancellation:

When you cancel your visa in the UAE, there is typically a 30-day grace period granted for individuals to wrap up their affairs and exit the country.

During this grace period, you are still considered legally present in the UAE but must make arrangements to depart before it expires.

It is essential to adhere to all visa regulations and ensure that you comply with any specific requirements related to your situation.

If you have any doubts or need further clarification on visa matters or timelines for receiving settlement amounts, it is recommended that you seek guidance from legal experts or relevant authorities in the UAE.

Dear A.,

Thanks for your inquiry.

Regarding the above, we would like to inform you that, according to UAE labor law, the employer must pay the employee all outstanding dues within 14 days from the date of the final judgment.

If the employer fails to do so, the employee can file a complaint with the Ministry of Human Resources and Emiratization (MOHRE) to enforce the judgment.

As for your eligibility to stay in the UAE, it is recommended to consult with the MOHRE or the General Directorate of Residency and Foreigners Affairs (GDRFA) for further clarification.

Generally, if you have a valid employment visa, you are allowed to stay in the UAE until the visa expires.

If you cancel your visa, there is usually a grace period of 30 days for you to leave the country. However, in your situation, it is best to consult with the MOHRE or GDRFA to confirm the grace period and any other necessary steps to take.

Kindly feel free to contact us by phone or email for further inquiries.

Greetings
