Can a company file an absconding case while the employee is outside the UAE?
Q: Dear Sir, I am currently outside the UAE for one and a half months. I received a notice from my company manager stating that they are filing an absconding case against me. They have canceled my visa. I checked the ICP Smart Services portal for visa status, and it currently shows the status as "canceled". I was employed in a RAKEZ company, and my visa (Limited Contract) was issued by the RAKEZ authority. My questions are: 1. Can the company file an absconding case while the employee is outside the UAE? 2. Can the company impose a lifetime ban on me for re-entry into the UAE? 3. Can the company cancel the residence visa before six months of completion while the employee is outside the country? 4. What will be the status of my ban, if they put an absconding ban on me? Q: Dear Sir/Madam, I was made redundant from my job after working there for a year. The reason given was that my role was being moved to another location due to restructuring. The company is offering to pay my salary for the notice period (2 months) and 1 month`s severance pay. I am seeking to increase the severance pay to 3 months. My reasons for this are that my dismissal was arbitrary, and the company has hired new people in the same capacity since my departure. If this escalates to court and the company does not increase the severance pay, do I have a strong case? I have asked the company to consider the extent of harm this dismissal has caused me on humanitarian grounds. Is my employer's withholding of my settlement a breach of contract?
Q: Hello Everyone, I was working with a private company in Dubai under a limited contract. I resigned after completing 1 year and served 30 days` notice period (I completed probation also). My total settlement amount was around 7300 AED. But the employer only gave me 3000 AED. He is holding back around 4300 AED as a visa and Emirates ID charge. My last day with the company was last week. I have requested to release this 4300 AED, but the employer refuses to do the same. Is this a breach of contract as the employer is saying the same and holding my settlement amount? If I complain to the ministry, will I get this pending amount or will the ministry support the employer? Please help me with your thoughts on this.
