I rented an apartment and paid to discover construction noises next door. Can I terminate the lease without penalty?
Q: I moved to a new apartment in Dubai DIFC (paying AED 250,000 annual rent) and I paid in one cheque. There is construction next to my apartment which is quite noisy and disturbs me. This will continue for 2 more years. They start to go higher and louder. I`m in the 60th floor. As I record Podcasts and work from home, I need a silent environment. In my contract, it is written: "In the event of the Tenancy being terminated by the Tenant before the expiry of the Tenancy Period, the Tenant shall be liable to pay 2 months’ rent as a penalty for such termination. The Tenant shall give notice of not less than 2 months." Would it be possible for me to get out of my lease agreement without penalty? I can stay 2 more months and give notice, but I wouldn`t like to pay the 2 months penalty (46,000 AED). Would it be possible to force the landlord to put soundproofing on his cost? A company that does soundproofing could add a glass layer and soundproof one room for 20,000 AED. Many thanks for your help A.

I resigned from my company and the company deducted my notice period after serving it. What to do?
Q: I resigned from my company last month after completing almost 1.5 years of service and have received my visa cancellation and labor contract termination. Although I only received the End of Service (EOS) document and details last week, I noticed that a deduction was made, with the company stating that I had not completed my notice period. Upon reviewing my contracts, I found that my company’s internal contract specifies a two-month notice period, whereas the MOHRE contract states only one month. I served approximately 35 days of my notice period. When I raised this concern with the company, they responded that it is their internal policy to deduct an amount from employees who serve less than two months of notice, regardless of what is stated in the MOHRE contract. I would like legal guidance on this matter. If I file a complaint, will it affect the remaining balance amount that the company is supposed to pay me? Thank you.2025/03/06

Q: Dear Sir/Madam, I have been involved in a criminal case since July 2024 and am currently under a travel ban. I got the judgment and penalty of 3700 which I paid but the prosecutor filed an appeal. What can I do after finishing all the execution steps and the company did not respond?
Q: I opened execution last week in the enforcement form which I signed and the same enforcement claimed to show in my online judicial account under my case number in the Abu Dhabi Judicial app. I believe that these are registered already to start enforcement after the timeframe finishes. Enforcement claims are as follows: 1. Seizing the trade license 2. Seizing accounts 3. Seizing cars Furthermore, I saw the notification from the court to the company that gave it 7 days to make the payment, but the 7 days were completed recently and the company has not paid yet. Kindly advise on any further steps from my side. Will the court start the enforcement measures from their side? When I opened execution, the above enforcement claim was included already.
