As a partner who loaned money to the company, should I sue the company or my partner?
Q: Dear Lawyers, I am a 50% partner in a company. I had given a 2M AED loan to the company about 10 years ago. There are expert reports and bank records to prove the loan. The company does not have any bank balances or assets. Should I start a lawsuit against the company and demand 2M AED, or should I start a lawsuit against the other 50% partner and demand 1M AED? One benefit of suing the company is that I can obtain an acknowledgment of debt, and later in an execution case, I can issue a certificate of solvency to have the other partner arrested. However, suing the other 50% partner directly would include their name in the executive writ. Please guide me! (I believe all necessary legal information is provided here. If something is missing, I can provide additional details here.)

What are the chances of recovering my money from a fraudulent immigration company?
Q: Good Morning, A fraudulent company committed to providing results from the AIP program in Canada. I paid approximately AED 80,000 in November 2023, and they gave me a post-dated cheque to ensure my amount. They failed to deliver the results as promised; the owner himself decided to roll back the program and proceed with a refund, but he eventually did not fulfill his commitments, even after agreeing to installments. We have been chasing him since March 2024, but he is not responding. He has nothing to say, and currently, he is not in the UAE. In this case, how can I recover my hard-earned money, which is for our children? How can I file a case? Currently, I am living in Saudi Arabia. I know there is some platform where I can raise an online complaint, but I’m not sure how long it could take to finalize the case. What are the chances of winning? Many people have been trapped in this fraud; I am not the only one. The owner committed this fraud through his sales employee with over 100 victims.

Negotiate asset split and spousal support: direct talks, mediator, or lawyer negotiations?
Q: Hello, I am currently getting divorced from my wife in Abu Dhabi. We are Americans, got married in the US 6 years ago, and are both non-Muslims. We are officially divorced and we wrapped up custody proceedings for our 19-month-old daughter last week and it was decided for 50/50, joint custody. I believe the next stage is for asset split and spousal support. Is that best handled with one-on-one talks with my ex-wife, or the use of a moderator, or have lawyer-to-lawyer negotiations? Also, can spousal support be paid from the former wife to the former husband? In the US this is very possible. I am very concerned about this as my ex-wife makes considerably more than I do (we moved to Abu Dhabi so she could take a lucrative position). Thank you!

Can I return to Dubai by paying only the court fine for a 2016 debt case?
Q: Dear Sir, I hope this message finds you well! I am writing to seek your advice regarding a debt case filed in 2016 in the UAE. The debt amounts to approximately 45,000 AED (20,000 AED cheque amount and 25,000 AED credit card amount). The associated interest has now possibly exceeded 150,000 AED. I have recently secured a job in Dubai and am eager to return; however, I am currently unable to pay the full debt amount. I am aware of a court fine of 5,000 AED. I would like to understand if there is any possibility of returning to Dubai by paying only this court fine and lawyer fee. Is the RERA rental index calculator applicable to hotel apartments?
Q: Dear All, I currently have an annual rent contract with a hotel apartment in Al Barsha, Dubai. I have a separate Ejari and pay my unit`s DEWA bills. My current yearly rent is the same as the rent advertised for new units in the same building. However, my contract renewal is due in three months, and the building management has informed me that a 10% increase in rent will be applied if I wish to renew. According to the RERA rental index calculator for the Al Barsha area, my current annual rent is already higher than the average rent, so no increase in rent is permissible. The building management has stated that they don`t fall under the RERA rental index because they`re hotel apartments. I wish to verify whether they fall under RERA rent index guidelines or not. Please advise. I am willing to open a rental dispute case and seek legal help, but I need to check if it will be valid. Thank you!

The applicability of the existing contract between the previous owner and tenant to the new owner
Q: Hello, I am buying an apartment to live in. The only problem is that the apartment is currently rented, and the tenant`s contract will end at the end of November. We talked with her, and she is willing to leave earlier. The real estate agent just sent me the contract between the current owner and her, which states that: "The landlord has to submit 60 days` written notice prior to the end of the contract to the tenant to inform them of any changes in the rent or terms and conditions (including vacating notice) of the tenancy contract." So, if I buy this apartment, will the rules stated in the contract between them apply to me as well? In the draft of Contract F, we also wrote that upon the completion of the transfer, the seller undertakes to send a notice directly to the tenant, in accordance with Clause 4.3 of the tenancy agreement, providing a minimum of 60 days` notice. Per Clause 4.3, the tenant is expected to agree to vacate the unit. Could this be enough? Thank you!+4

Q: Dear Sir/Madam, I signed an MOU on March 22, expecting building completion in April. The MOU had an expiry date of April 22; however, due to rain on April 15, the completion was delayed until May 30, 2024. I received the BCC on June 17 from the developer and paid for the pre-title deed on the seller`s behalf to expedite the process. Now, I have completed the pre-approval and valuation, but the bank is asking for the handover notice to release the final cheque, which the seller is refusing to share. The seller claims the MOU has expired, but it includes a force majeure clause. So, is this MOU still binding or not?+4

The landlord does not sign the move-out permit upon contract end. What options do I have?
Q: Dear Lawyers, My rental contract expires in mid-August. I don`t owe any money to my landlord; all rent is paid. They contacted me 110 days before expiration and mentioned a rent increase if I choose to renew. I responded that I do not intend to renew. I plan to move out next week and requested a move-out permit 10 days ago. The Community Management has already sent four requests to the landlord`s company to sign the permit and has called them several times. Each time, the landlord`s company claims someone else is responsible. I have also contacted the landlord`s company, encountering the same issue; they cite different responsibilities. Responses to my WhatsApp messages are evasive. Today, the CM informed me that if the landlord does not sign, I will not be allowed to move out, and the community management cannot intervene.
