Q: Canceling rental agreement before signing it. By email, I agreed to rent an apartment, no lease or contract has been signed. However, the agent asked for a photo of the cheques for verification purposes only, which I provided. No money or physical cheque has been exchanged. How easily can I back out of the agreement? Can the payee of a cheque use a photo of a cheque I sent a picture of it on WhatsApp?
Q: Greetings, I shared a photo of a cheque with the payee for verification purposes only, not for deposit. Our WhatsApp communication has been clear on this. I recently found out that it may be possible to encash a cheque using a photo or printout instead of the original cheque… Now, I worry the person may actually deposit the cheque using the photo I shared. Is this possible or plausible, would this be a fraud? Should I preemptively block the cheque? The jurisdiction is Dubai. I still have the physical cheque in my possession. As it seems the company is not satisfied with my performance, they have told me verbally that they don’t need my services anymore. Can I get my money back from the seller after a mistake by them and the MoU will expire?
Q: Dear Sir/Madam, I`m a buyer and came to the final stages of the process, all cheques have been issued and shared. I was pushing developers about NOC (the seller takes things very slowly), and they realized a big mistake in the documents, the Dubai Land Department gave us a Title Deed instead of a Pre-Title Deed. The bank prepared all cheques through that. Our MoU expires in a couple of days. We offer the seller to extend the MOU to provide documents. So whose fault is it? If the seller decides not to continue with the process and not renew the MoU, what would be my rights here? Can I get back my cheques and be covered by the seller legally? Thank you
