Can I get my money back from the seller after a mistake by them and the MoU will expire?
Dear Sir/Madam,
I'm a buyer and came to the final stages of the process, all cheques have been issued and shared.
I was pushing developers about NOC (the seller takes things very slowly), and they realized a big mistake in the documents, the Dubai Land Department gave us a Title Deed instead of a Pre-Title Deed.
The bank prepared all cheques through that. Our MoU expires in a couple of days. We offer the seller to extend the MOU to provide documents.
So whose fault is it?
If the seller decides not to continue with the process and not renew the MoU, what would be my rights here?
Can I get back my cheques and be covered by the seller legally?
Thank you

Dear Questioner,
Thanks for your inquiry.
Regarding the above, we would like to inform you that, in this situation, it is important to review the terms and conditions of the MOU and any other agreements that have been signed between you and the seller.
The MOU should outline the responsibilities and obligations of both parties, including any deadlines or timelines for completing the transaction.
If the seller is at fault for the mistake in the documents, they may be responsible for any delays or additional costs incurred as a result.
However, if the MOU does not specifically address this issue, it may be difficult to determine who is at fault and what the consequences should be.
If the seller decides not to continue with the process and not renew the MOU, you may have the right to terminate the agreement and request the return of your cheques.
However, this will also depend on the terms of the MOU and any other agreements that have been signed.
It is recommended that you seek legal advice from us. We will be able to review your documents and advise you on your rights and options in this situation.
Please feel free to contact us by phone or email.
Greetings,
Hello,
As per your query, please note that if there is a breach from the seller side that is not as per the MOU, then you can claim compensation from the seller, twice the amount.
Please share with us the MOU by email or call us.
Dear Questioner,
If the seller decides not to continue with the process and not to renew the MOU, then normally, you will be entitled to receive compensation according to the terms and conditions enclosed within the MOU.
In order to ensure your rights, we have to review the document itself.
