Is a photo or printout of a cheque legally valid for deposit?
Hi,
In the UAE, is a photo or a printout of a cheque as valid as the original cheque, and thus can be legally deposited?
If so, does this apply if both drawer and payee are individuals?
Many thanks for the advice!
Best Regards,
Dear Client,
Thanks for your question! I hope you are doing well. I will assist you in this matter.
In the UAE, a photo or a printout of a cheque may not be considered as valid as the original physical cheque for deposit purposes.
Banks typically require the original physical cheque to process transactions securely and mitigate the risk of fraud.
It's advisable to present the original cheque for the deposit to ensure a smooth and legally compliant transaction.
If necessary, you can inquire with your bank for specific guidance on their policies regarding cheque deposits.

Good day,
In general, while a photocopy or printout of a cheque may serve as a reference or record, it may not always be considered legally valid or sufficient for certain purposes, especially in formal banking transactions or legal proceedings.

Dear Questioner,
In the UAE, a photo or printout of a cheque is not considered a valid substitute for the original cheque and cannot be legally deposited for several reasons:
- Security Concerns:
Photos and printouts can be easily forged or manipulated, posing a security risk to both the bank and the parties involved in the transaction.
- Legal Requirements:
UAE laws and regulations, including Federal Law No. 1 of 2006 concerning Electronic Transactions and Commerce, generally require the presentation of the original physical cheque for transactions like deposits.
- Dispute Resolution:
In case of any dispute regarding the cheque, the original document serves as the primary evidence in legal proceedings.
However, there are some exceptions:
- Electronic Cheque Images:
While not a common practice, some banks in the UAE might accept electronically transmitted images of cheques as valid for specific purposes, provided they meet certain security protocols and the original cheque is retained by the bank.
- Lost or Stolen Cheques:
If the original cheque is lost or stolen, you can report the incident to the issuing bank and inquire about alternative procedures for accessing the funds. This may involve filling out a lost cheque form and providing relevant documentation.
It's important to always consult with your bank for their specific policies and procedures regarding cheque deposits.
They can advise you on the appropriate course of action based on your specific situation.

Dear client
The copy of the cheque will be considered as original because it is an office document issued by the bank. However, if any party claims the cheque is fake, the original must be submitted.
