Unfinished motorcycle repairs and unfair fees at a workshop: What to do?
Q: Dear Sir/Madam, My motorcycle was taken to a motorcycle workshop for repairs due to a coolant leak. After examining the bike, they provided me with a quote and later informed me that the oil and water had mixed, necessitating an engine flush. Although hesitant, I trusted their expertise and paid an initial fee of 5900 AED. Unfortunately, it has been two months since the deposit was paid, and the repairs are still unfinished. When I recently followed up with them, they informed me that the bike lacked compression and power and needed new piston parts. This seems implausible since the engine was running smoothly before the rebuild. It appears that the mechanic did not properly assemble the engine initially, and now they want to charge me an additional 10000 AED to fix their mistake. They continue to increase the cost and make excuses for the delay, even though it should not take three months to rebuild an engine. What are my options?

س: السلام عليكم، أرجو التوضيح! من المعلوم أن الاتفاق أمام التوجيه الأسري وفق المادة 16 الفقرة الثانية يعتبر سندًا تنفيذيًا ولا يجوز الطعن فيه، ولكن أيضًا النفقة ذات حجية متغيرة ويُراعَى فيها الزمان والمكان، فهل إذا اتفق الطرفان على مبلغ نفقة لا يحق لأحدهما طلب الزيادة أو النقصان بعد مرور سنة؟

How to get real estate developer to fix moisture issue in a new apartment?
Q: Dear Sir/Madam, I recently purchased a new apartment unit from a real estate developer, and the unit is brand new. The building`s completion certificate and civil defense certificate were issued in September. The handing over and snagging was completed last November. However, after receiving the apartment, I noticed that the paint was peeling off due to moisture in the walls. Since the unit is still under a 1-year warranty, I have contacted the customer service of the developer to rectify the problem. Unfortunately, the maintenance team only painted the walls and did not address the underlying issue. The problem has persisted for six months and is only getting worse. I am wondering what steps I can take with the developer to get them to fix the problem. How can I file a complaint and receive real support from the developer? Should I consider appointing a lawyer and granting them power of attorney? Is it worth the cost? Q: Hi, Our resigned employee filed a labor complaint in MOHRE to claim unused air tickets amount. As it was not amicably settled, labor transferred the same to the court. But till now we didn`t get any intimation from the court as maybe the employee didn`t register the complaint. So what will be the next step taken by the company? New owner in Dubai with no Ejari and previous tenant: What are his rights?
Q: Dear Sir/Madam, I recently purchased a studio flat in Dubai that was previously tenanted under a Tenancy Contract from November 2022 to November 2023. However, there is no registered Ejari to establish a tenant-landlord relationship in the Dubai Government record. The previous landlord had given the tenant a year`s notice to vacate the flat, which was given six months ago. Now that I have purchased the flat, I have asked the tenant to replace the cheques, but she has refused to cooperate. Can you please advise me on whether I am obligated to continue the Tenancy Agreement signed by the previous owner, given the absence of an Ejari? Alternatively, when can I tell her to vacate the flat, or do I have to wait until November 2023? Secondly, I would like to know if I need to serve the tenant with an eviction notice again to vacate the flat. Q: Hello, I recently bought a property in Dubai with the intention of moving in. However, there is a current tenant who was served an eviction notice by the previous landlord. The eviction notice is set to expire on June 8, 2023. I have asked the tenant when they plan to move out, but they are refusing and claiming that the eviction notice is void because there has been a change in ownership. How to recover unpaid funds from a guest who left without paying?
Q: Dear Sir/Madam, We are a registered company that provides accommodation in Dubai. One of our guests partially paid for his stay and claimed to have an issue with the bank. He promised to pay the remaining amount before departure, but left the property without informing us and left an unpaid bill of 6000 AED. After departure, the guest apologized for the delay in payment and assured us that it would be paid shortly. However, the payment has not been made yet. It has been over a month now, and the guest continues to acknowledge the debt and promises to pay as soon as he has funds (there is proof of this through multiple messages). Credit card fraud: Bank threatens travel ban and civil case
Q: Dear Sir/Madam, I need some advice. I had a credit card that I cleared when I learned about the acquisition of the bank by another one. After settling all my dues, I kept the card at home and stopped using it. However, I experienced a fraudulent transaction on my card, amounting to close to 32,000 AED. When I received a message from the bank with an OTP, knowing that I did not initiate the transaction, I immediately called the bank to block the card. They asked me to file a dispute, which I did, and they assured me that the transaction would be stopped since the card was blocked. Unfortunately, two days later, on October 19, 2020, the money was deducted from my account. After the acquisition, the bank advised me to fill out the dispute forms again and file a police report, which I did. I have kept all records from day one until now, which has been almost 2.5 years.
