س: أعمل حاليًا بشركة بالمنطقة الحرة بمطار دبي. لكن الوظيفة ليست جيدة وأود أن أغادر هذه الشركة، وقد وقعت عقدًا لمدة 3 سنوات وعملت لمدة 9 أشهر حتى الآن. ينص العقد على إخطار الشركة برغبتي في الرحيل قبل شهر، لكن صاحب العمل يريدني أن أعمل لشهرين إضافيين، ويقول أن سياسة الشركة لا تقبل خرق بند التعويض بالعقد وأنه يجب عليّ أن أعمل لمدة شهرين بدون أجر. يجب عليّ أن أدفع له نصف راتبي لمدة ثلاثة أشهر، لكنه لم يوافق على أن أعمل لمدة شهر (الذي هو مدة الإخطار) بدون راتب. أفكر في الهرب والعودة لوطني. هل سيتم حظري من العمل والعودة إلى الإمارات في هذه الحالة؟ بالإضافة إلى ذلك، كنت قد تلقيت عرضًا من أحد عملائنا، لكن عقدي يحتوي على بند عدم منافسة. هل يعد هذا البند ساريًا على الرغم من أن الشركتان تعملان بمجالين مختلفين؛ إحداهما مورد منتجات، والأخرى شركة استشارات؟ أفكر في العودة إلى بلدي لأن صاحب العمل متعنّت معي ويصر على أن أعمل لمدة شهرين دون أجر. أسئلة وأجوبة

س: سيدي العزيز، يومًا طيبًا. أعطيت شخصًا ما (كان يرغب في تأجير شقة) 150.000 درهم لأنه كان يعاني من ضائقة مالية. ووعدني أنه سيرد لي المال خلال 3 أشهر، وقام بتحرير شيك بالمبلغ كإجراء تأميني. وقد سدد لي 3 شيكات خلال 3 أشهر بواقع 36.000 درهم. وبعد شهر، غادر ذلك الشخص الإمارات ولم يعد لمدة 6 أشهر. والآن مر 8 أشهر ولم يدفع لي شيئًا وهو الآن في دبي. لذا تواصلت معه فقال لي: "ليس معي مال، افعل ما تريد". فكرت في اتخاذ إجراءات قانونية صحيحة، فقمت بإيداع جميع الشيكات التي تبلغ قيمتها 186.000 لكنها ارتجعت اليوم. برجاء مساعدتي في كيفية اتخاذ الإجراءات القانونية الصحيحة، وكيف لي أن أستعيد أموالي؟ أنا أعاني من ضائقة الآن، وقد أخسر مستقبلي في الإمارات بسبب هذه المشكلة. أرجو المساعدة. تحياتي، دنيش أسئلة وأجوبة

Drafting referral agreement to guarantee the payment of commission
Q: Dear Sir/ Madam, I am Sammy based in Nairobi, Kenya and I`m about to deal with an electric company in Dubai. I want to provide the company with business and in return, I get my commission from them after the deal is done. My issue is that we may have an email agreement with them, but later after the business is done they may evade from sending me my commission. Refund of money paid for purchasing a beauty salon that never happened
Q: Hi, We are planning to buy a beauty salon and we have given the owner a deposit of AED 20k. After a week he asked for another AED 50k as he has dues that need to be settled with the landlord. He gave us a cheque for AED 50k which bounced because the account has been closed a long time back as per the bank. It’s been 49 days and the transfer is not done yet. The employee's rights upon resignation from a government entity
Q: I worked for a Federal Government entity in the UAE; this entity was created by special decree so it doesn’t have a normal trade license or Labour contracts from MOL. Instead, we have signed employment contract which states it is governed by Labour Law of 1980, other federal laws and will be in the jurisdiction of Abu Dhabi. My employment visa is from the emirate of Dubai as the entity also had a branch in Dubai. I recently resigned from my job serving 3-month notice as mandated by the HR policy. My resignation got accepted within a day and I was advised that this day would be last working day, and my notice period has been waived off. I was just short by 15 days in completing 3 years of my service, and I had planned by cash flows assuming I would be getting paid for the next 3 months. Now, I am in a very bad situation as the employer is insisting I am not legally entitled to 3 months pay. I need your urgent advice on the matter as the Labour Ministry cannot get involved due to the absence of labour contract. أسئلة وأجوبة

Redundancy and constructive dismissal
Q: Hello there, I have been informed by my employer for 34 months, that my position is no longer required in our Dubai free zone office. I was employed in 2014 to take up a Dubai-based position and I was informed that I would be taking over a Middle East Director in two years. They have asked that I relocate to the UK in 3 months to take up the same position, they have given me 1 week to accept this offer. Given that there is no mobility clause in my employment contract and offer letter, would I be within my right to refuse this offer on the grounds that it is unreasonable as we now know that it would take us (a family of 4 with 2 children) longer than 3 months to plan and move the family back to the UK? What rights do I have if my employer were to make my position redundant, would I have grounds to sue for constructive dismissal as my performance has never been in question? أسئلة وأجوبة

What to do if your company forces you to submit your resignation
Q: Hello & Ramadan Kareem, I`m working in JAFZA (Jebel Ali Free Zone) as a Regional Manager on a limited contract ending in 2019. I shall be completing 1 year on 16 June 2017. My Management is pressuring me to submit my resignation (with a 30-days notice i.e. defined in their offer letter) as they say I have not delivered the annual sales targets. Since I refused, the HR Manager called & threatened me with "consequences". My JAFZA contract clearly mentions 90 days notice period. Q: Hi, I am currently having an issue due to 2 investment policies that were grossly and unethically mis-sold from a reputed international bank... I did not pursue this thru a court of law, but managed to get my complaint to the very top of the organization by the grace of God over several months of exchanges and dialogues. But since the dialogue has always been with a corporate and having no legal help, even though the bank has consented to return 75% of my loss at the further end of many months ...on the capital, I still feel that the bank is not being fair with me with what their stance is...
