Divorce and settlement for Muslim expats in the UAE
Q: I`m Tunisian woman married to a British passport holder and we`re both Muslims married in Qatar and live now in UAE. I want to know what happens if I ask for divorce. We grew apart and he`s been nasty with me, threatening me to have a mistress or get married again or even threaten to hit me if I reply to him during an argument. We have a joint account with full ownership (anyone of us has full authority over the account) for both of us but I actually own 90% of the money in it. Lately, after our relationship started suffering, I discovered he transferred all the money to an off-shore account and he didn`t consult me or ask for my permission, until he didn`t tell me about it. I don`t trust him anymore and want to divorce and have my money. Would filing for divorce affect me or my assets (I have another separate current account)? Would I be able to get my money back? Refusal to pay for the job done
Q: We are a software company who have signed a contract with a client. The contract expired in Nov. 2015. We continued to work with the client on the project. We received 5 payments out of 7 payments that were due. Each payment was linked to a milestone in the project. Now the client claims the software solution is not up to the quality they want and they want to sue us for damages. In the contract, we have a clause that says they can sue for a maximum of 50% of the money they paid us. However, each of the 5 payments they made were linked to a milestone of the project contract and the payments that were made were approved by their managers who now claim that the software quality has an issue. Q: Hi, I just wanted clarification on something. I recently wrote to a clinic where I had a bad experience - in a private email - to complain about the service. The clinic has now threatened me with breach of Federal Law. I haven`t published anything on social media but did say in my email that I wouldn`t recommend the clinic on platforms where families chat about which clinic they should choose for IVF. Termination of tenancy due to hidden fault of the premises
Q: Hi, I only recently rented a small 1 BR in Mirdiff Ghoroob gated community. However, it has been brought to my attention a constant presence of unbearable sewage smell at night time which disturbs my sleep almost every night. I spoke to the property and maintenance office and only realised that the stench is not caused inside the community but by the closeness of the sewage plant treatment. I am afraid I cannot get used to living in such an environment especially since I suffer from respiratory allergies. I already filed a complaint to the municipality but nobody came to resolve it. Q: I wrote a check for AED 400, the check bounced. They sent a letter saying if it was not paid in 10 days they would follow through with legal proceedings. It has been 21 days, I am paying it today. Q: Good morning, I have a loan from the company and was terminated within the probation for a breach of confidentiality (I have sent an email to my personal email address!). Can the company ask the money back? Company is conducting fraud with the visa sponsor (Dubai Airport Free Zone) and let`s everyone sign a second contract with lower basic salary in order to avoid deposits with the visa sponsor, deducts money for each and everything from staff salary, records all phone conversations without advising the customers and so on and so on.
