New developer wants to change payment terms. How to me to protect my rights?
Q: Dear Sir/Madam, I bought a residential property for AED 7 million in Dubai from a developer in 2013 and registered the property in the same year. The project has been delayed and is still not complete. The original developer sold/transferred the project to another developer in 2022. The project is now 60% complete as per the latest RERA inspection report. The original payment terms in the Sales Purchase Agreement were a final balance payment of 40% to be payable on the handover of the property. However, now the new developer has drafted a new Sales Purchase Agreement where he is demanding 90% to be paid in stages while construction is in progress, and only a balance of 10% to be payable on the handover of the property. The RERA website states project completion by Dec 2025. Please advise if the new developer has the legal right to change these payment terms. What if the broker didn't collect the deposit cheque, and the seller wants it?
Q: Dear Sir/Madam, I have a question related to a real estate transaction in Dubai. One of my clients signed an MOU but couldn`t complete the deal on time, and the MOU has now expired. The owner wants to claim the deposit, but unfortunately, I did not collect the deposit cheque from the buyer; he only sent me a picture of the cheque at the time of completing the MOU. So, my question is, what consequences might I face for not collecting the cheque from the buyer if the seller takes legal action to collect his 10% deposit? A new landlord cannot collect the rent from the tenant. What to do?
Q: Dear Sir/Madam, I am a European resident and have owned an apartment in Dubai since November 8, 2023. The contract with the previous owner ended in September 2023, and the tenant was served an eviction notice until July 2024. I find the tenant`s behavior very problematic and am considering legal action. He has not paid any rent to me since I took ownership. I invited him for a new 1-year contract without a rent increase, but he insists on forcefully signing the contract at the Dubai Land Department without my or my POA`s signature and is compelling me to visit Dubai to collect the cheques. Can you help with the following: 1) How can I get my rent? 2) Can the Dubai Land Department enforce the lease contract without my approval? 3) Given his behavior, I do not want to continue the lease agreement with him. Can a school give parents the personal mobile numbers of teachers?
Q: Dear Sir/Madam, I am a teacher at a school in Dubai. Can my employer, the school, provide my personal mobile number to parents? I am employed by the school, and the school has my phone number. But the school is forcing teachers to provide our personal numbers to ALL parents. The parents are provided with teachers` school email addresses and educational platforms to message the teachers with any questions, but because the parents are lazy to email or learn how to use the platforms for messaging, the school is forcing us to provide our mobile numbers to parents. Is it legally allowed for the school to force teachers to provide their personal phone numbers to ALL parents, who do not respect the teachers` privacy and message/call at non-working hours? And then the school expects teachers to respond during non-working hours and weekends. MOST teachers do not want to provide their personal phone numbers. Q: Dear Sir/Madam, My landlord has just given me a 12-month notice to vacate the villa. I know that this is because rents have increased significantly, and he wants to rent it out at a higher rent. As I understand it, landlords can only ask tenants to vacate if they want to sell the property or live in it themselves. Which date does the tenant vacate: lease end or notice date?
Q: Dear Sir/Madam, I bought a property that was transferred to my name a few days ago. The previous owner had served a legal notice to vacate (reason: sale) and renewed the lease agreement for 9 more months three months after serving the notice, to align with the notice to vacate. After the transfer, I was able to access Ejari via the Dubai Rest app and saw that Ejari was renewed for 12 months instead of 9 months. Does this mean that the tenant has the right to stay until the end of the Ejari date or the date on the legal notice and lease agreement? FYI: The date on the notice served via the Dubai Court is January 31, 2024. The lease agreement is January 31, 2024, but Ejari is April 30, 2024.
