A new landlord cannot collect the rent from the tenant. What to do?

Dear Sir/Madam,

I am a European resident and have owned an apartment in Dubai since November 8, 2023. The contract with the previous owner ended in September 2023, and the tenant was served an eviction notice until July 2024.

I find the tenant's behavior very problematic and am considering legal action. He has not paid any rent to me since I took ownership.

I invited him for a new 1-year contract without a rent increase, but he insists on forcefully signing the contract at the Dubai Land Department without my or my POA's signature and is compelling me to visit Dubai to collect the cheques.

Can you help with the following:

1) How can I get my rent?

2) Can the Dubai Land Department enforce the lease contract without my approval?

3) Given his behavior, I do not want to continue the lease agreement with him. How can I evict him as early as possible?

Please help!

Dear Questioner,

Since his tenancy contract expired in September 2023, the old owner should have signed the new tenancy contract and gotten the rent but it seems that he did not do that which explains the tenant's behavior.

Anyway, please send the tenancy contract, the eviction notice, and any other relevant documents you have for my examination.

We can help you to get your rent and evict him as soon as possible.

RDC can't enforce the lease agreement without your approval.

For more information, don't hesitate to get in touch with me.

There are several points to be considered. First, he can't default on the payment of rent.

If he does, then you can evict him by serving a 30-day notice for non-payment of rent. He cannot deny your ownership since you have already sent him the transfer of title deed.

We will discuss more on this issue on a legal consultation session for a charge.

Share your WhatsApp number if you want to go with the services.

Dear Client,

Thanks for your question! I hope you are doing well. I will assist you in this matter.

To address your concerns in Dubai as a property owner, kindly check the following:

1) If the tenant hasn't paid rent, send a formal notice and, if necessary, file a dispute case with the Dubai Rental Dispute Center.

2) The Dubai Land Department typically requires landlord approval for lease contract registration; consult with DLD to prevent unauthorized registration.

3) To evict the tenant, follow legal procedures; including issuing eviction notices and obtaining a court order.

4) If you want to terminate the lease, provide proper notice, usually 12 months, and document communication with the tenant.

For any further legal assistance, you can WhatsApp us. We have an extensive team of knowledgeable and experienced lawyers to provide the legal assistance you need.

We will be happy to help you.

Thanks & Regards,

ABDUL WAHIED

Dear Questioner,

I hope this message finds you well. Thank you for reaching out with your concerns regarding your property in Dubai.

I understand the complexities involved and I am here to guide you through the legal processes. Based on the information you've provided, here are some initial insights:

- Recovery of Unpaid Rent:

To recover the unpaid rent, we can initiate legal proceedings to enforce the terms of the lease agreement. It's essential to gather all relevant documents, including the lease agreement, notices served, and communication with the tenant. Through legal channels, we can pursue the outstanding rent on your behalf.

- Dubai Land Department (DLD) and Lease Enforcement:

DLD typically requires the consent of both parties for any lease registration. If your tenant is attempting to register the lease without your approval, this may constitute a violation. We can take legal steps to prevent unauthorized registration and protect your interests.

- Termination of Lease Agreement:

Given the tenant's behavior and your desire to terminate the lease, we can explore legal avenues for early termination. The eviction process involves specific legal steps, and I can guide you through the process to ensure a swift resolution.

To discuss your case in more detail and explore the best strategy for your specific situation, I recommend scheduling a consultation.

Please feel free to reach out to me via WhatsApp or phone. I am here to provide the legal support you need.

The change in real estate ownership does not impact the lease agreement.

In the event of rent non-payment, the landlord can issue a 30-day eviction notice through either notary public or registered mail.
