Travel ban check
Q: I want to know is there any Travel BAN for me. I didn`t pay my credit card payments for 3 months, I am still in the U.A.E. I am going to India for annual vacation for one month. I`m trying to settle one credit card amount and I also missed last month payment for a 2nd credit card. Is it correct, If I have AED 150 due on Etisalat bill I can`t go outside the U.A.E.?

How to lift one-year labour ban
Q: Hi Sir, Myself Rijo, presently I am facing one-year labour ban (as per my knowledge and same mentioned in cancellation paper too). Now I have a new offer with DMCC free zone but things were not processed because of this ban. DMCC asked me for the immigration clearance. How can I clear this? My previous contract was under limited term so even salary basis also is not helping me. From other sites I came to know it is possible but still have no idea how, so can you suggest me a solution?2017/08/09

Car selling fraud
Q: I had a deal with a transport company to buy a vehicle. I had given them post-dated cheques to hand over the vehicle to me. After that, neither they handed over the vehicle nor returned the cheques. I tried to contact them but all in vain. In the end, I had registered a case in Dubai Courts. The case was referred to AMICABLE Disputes Department. No one from that company came for the hearing. A guy in AMICABLE Department told me that they tried to contact the company on contact details e.g. mobile number, landline and fax & physical address provided on their trade license but could not have a contact. So I was told that the case will be referred back to Dubai Courts and I need to get a hearing date from the Judge. Yesterday I approached the bank and asked them if I can block the issued cheques and I was told that yes, it can be done. My question is that, will it be a wise step to block the cheques and continue the case in court? Kindly suggest. Thank You. Regards.2017/08/09

What to do if your lawyer doesn't meet your requirements
Q: Hi, I have approached a lawyer because they promised to solve my case in a weeks time. I went and paid the fees on 9th of July and got 3 copies attested from Dubai courts and submitted all. I have been hearing from them that they will do it today, tomorrow and it`s been nearly a month and case manager is just telling "today, tomorrow". I have lost trust and hopes. I approached them for a solution and they promised it within a week, not in 3 weeks, and they have not even sent the legal notice. Please advise what should I do?2017/08/05

كيف أخرج من عقد إيجار ملزم
س: أعيش الآن في شقة إيجار مكونة من 3 غرف في حي دبي مارينا، بإيجار قيمته 200,000 درهم سنويًا مدفوع على 4 دفعات، ومدة الإيجار سنتين، أي أنه بقي عام من مدته اعتبارًا من يوم 1 سبتمبر 2017. عندما أبرمت العقد، أخبرني ابن صاحب الشقة (الذي يمتلك توكيلًا منه) أنه لا يمانع أن يشاركني الشقة بعض أصدقائي، حيث كنا 3 أصدقاء في ذلك الوقت. المشكلة أنني فقدت وظيفتي، لذلك واجهت بعض الصعوبات في دفع الإيجار، لكنني قمت بدفعه في النهاية وسوف أقوم بتسوية أية شروط جزائية في العقد. إلا أنني أرغب في إنهاء العقد مبكرًا، وقد بدأ صاحب الشقة يتولي المفاوضات بنفسه وخرج ابنه من الصورة. والآن أخبرني صاحب الشقة أنه لا يمكنني مشاركتها مع آخرين، وأنه لكي أتمكن من إنهاء العقد، لايد من دفع رسوم تبلغ إيجار شهري، أي حوالي 35000 درهم. لا يمكنني البقاء في الشقة وحدي، وإلا سأعجز عن دفع الإيجار. هل يمكنك تقديم أي نصيحة لي في هذا الموقف. ريتشارد

How to force the landlord to refund the security deposit
Q: I moved out of an apartment in Abu Dhabi on 5th of June 2017. The property management company issued me with a clearance certificate for the air conditioning with the intent of deducting the final amount owed from the security deposit. It is almost two months later and they still have not refunded the balance of the security deposit. I have made repeated requests to get the money back but they are just wasting my time. How can I proceed to get this money back? In my home country, we can go to a small claims court in which the defendant would be ordered to pay, plus pay the court fees. I tried to find similar on the ADJD website but could not and as the amount is for 1300Dhs, I don`t want to have to spend this filing a court case, if I am liable for the fees also.2017/08/03

On which stage should I form a company for a new business in the UAE?
Q: Hi, I am planning to start a business consultancy company in the UAE which will manage and run the complete business. We have our own projects in the paper for which we require partners. At the same time, we are inviting individuals to show their interest to be part of any project as they will inform us their financial capability and once we will have sufficient number of people then we will form a separate LLC company in which all the investors will be the partners and our company will be the consultant to them. If I want to do this by sending one video to my contacts on social media... is it fine and legal? Should I form the company first before sending the video presentation of the concept... as we are not taking any money from anyone... just to analyze the response of the people? Thanks.2017/08/03

Is employer liable for drink-driving of the employee?
Q: Hello, I`m looking for some advice. My husband`s employee who is a Sri Lankan man has had an accident whilst driving a lease car in a hotel car park. Stupidly, he never reported it and went into the hotel where he was staying. In the morning the police came and arrested him. Today he went to court and was given a 26,000 Dirhams fine. It was not possible for my husband to speak to his employee but the police have charged him with drink-driving and leaving the scene of an accident. As my husband is his employer and sponsor, will he have to pay the fine on his behalf? The guy earns 4,000 Dhs per month. The hire car from Diamond Lease has been impounded and won`t be released until the fine is paid and then I guess the company will impose more fines. My poor husband is at his wit`s end and at the courts in Abu Dhabi he cannot find anyone to speak to about the situation. Has anyone experienced anything like this or know who we can turn to for advice? Would be very grateful for any help. Thank you.2017/08/03

س: هل عقد تنازل الموظف عن مكافأة نهاية الخدمة قانوني في الإمارات؟ لم يدفع لنا صاحب الشركة التي كنت أعمل بها راتب آخر شهر ومكافأة نهاية الخدمة، وقد طلبت منا الشركة توقيع عقد تناول، وإلا لن يدفعوا لنا شيئًا. وبعد توقيع التنازل، لم تدفع الشركة شيئًا، ويبدو أنهم لا ينوون دفع شيء، بل ينوون عرض تلك الوثيقة على المحكمة.2017/08/03

How to sue your employer if you don't have the labour contract
Q: I am Jasim. I filed one case against the company in Dubai Court in commercial dispute category. The company offered me a good position and told me to resign from the previous employer and at last, they sent me the visit visa and told me to join the company. They informed me they started my visa processing. After working for 2 months I did not get my salary and I came to know I was cheated and they had no visa quota due to pending salaries to the employees. Now I am in the 5th hearing stage in the Dubai Court chamber. Now, the judge informed me that my case will be rejected if I do not submit a case transfer paper from the Ministry of Labour Court to Dubai Court. What I have to do now? I had no visa to start the case in Labour Court. I went there first, but they told me to go to Dubai Court since I was on visiting visa.2017/08/03
