Effects of resigning during the probationary period
Q: I am living in Dubai under my husband sponsorship. I started a new job two months ago, but this is not the job for me. If I resign during my probation period, is there a possibility of getting a one-year labour ban? I got very mixed reviews on this and I want to find another employment, but certainly, I do not want a labour ban imposed on me.

Police case for bounced cheques issued for rent
Q: We rented a business working space at one of the business centres. We used the premises for two months but the service was very bad. Moreover, our business was a startup, hence it didn`t take up. The business centre management had agreed on vacating the place within a week as per our deal. Now, they are not returning our security cheque. We were supposed to pay only AED 4000 for an early exit. They are arm-twisting us by depositing our monthly cheques along with the security deposit, which of course bounced and they made a police case for which we paid the fine. They are purely cheating and trying to take the pending rent, but it was agreed that we can vacate. Please advise what is the next step we can take.2017/10/15

Initiating a case against an immigration consultancy company
Q: Hi, I have a dispute with one immigration consultancy firm in Dubai. I have signed an agreement with them for seeking their services two years ago. However, later I came to know that they have not provided complete information for qualification on the first instance due to which my case does not qualify at all for Canadian immigration. Now, I am asking for cancellation of the agreement, which they refuse claiming it was my mistake. Kindly advise regarding the right forum and the way to proceed legally with my case. Forcing a tenant wrongfully accused of sublease to pay a penalty
Q: I and my family are living in a home rented by Al Wasl Properties. It is leased to my dad`s employer Khaleej Times and there has been a false allegation by Al Wasl Properties that we have subleased the home to someone without any evidence. The only evidence they have are two Emirates IDs of two men. We are being forced by my dad`s employer to pay the penalty, as they don`t want to have a headache because of this case. We feel helpless as we haven`t done any offence nor subleased it, yet we are being forced to pay a penalty of AED 8000. I would really appreciate if I can get an advice on how to act against this?

تراجع الشركة الجديدة عن عرض العمل بعد الاستقالة من وظيفتي القديمة
س: أنا بحاجة لمشورتكم في أمرٍ ما. كنت أعمل بشركة في أبو ظبي وتلقيت دعوة مقابلة عبر الهاتف من شركة في دبي. اجتزت مقابلتين وتم اختياري للوظيفة، ثم تلقيت خطاب عرض وظيفي. وبناءًا على ذلك، استقلت من وظيفتي السابقة وعملت لمدة شهر بدون أجر (مدة الإخطار). بعد ذلك، انضممت إلى الشركة الجديدة، وبعد مرور أحد عشر يومًا، رفضت الشركة التقدم بعرض وظيفة لي. لا أعرف ماذا أفعل بعد أن فقدت وظيفتي بسببهم. أحتاج لمعرفة حقوقي القانونية في هذا الموقف، وما هي الإجراءات القانونية التي يمكنني اتخاذها ضد هذه الشركة.

Termination during probation period in a limited contract
Q: Hello Ma`am, I just want to ask for advice, as my employer just recently terminated me under a limited contract. I was hired July 2, 2017, and last Wednesday, Sept 20, 2017, the newly hired HR and General Manager spoke with me that they will no more continue my contract with them. They are claiming that I have made delays which I`m not aware of, and they didn`t send me any warnings through email. I have filed one-day sick leave when I was not really feeling well. Immediately on that day, they gave me a cheque which I served for 20 days only. They just told me without any notice period, and haven`t informed me or warned me if I have committed mistakes with their policies. Is this right? Thanks in advance.2017/10/12

Checking a possible ban for unintended overstay in the UAE
Q: Hi Sir. Hope you are doing well. I came to Dubai on a visit visa in 2014. I got a job and the owner of the company asked me for money to issue the employment visa. I paid him the amount, but the employer didn`t apply for my visa and went to his country. I filed a case against him in the court, but he didn`t come to the court after he returned to Dubai. The main problem was that I had given him my original passport, and that`s why I didn`t exit the country. After 10 months, I went to Al Aweer jail and I took exit without paying overstay fine. I had given fingerprint and eye scan also. Now, I want to come back on partner visa and I want to know if I can come on that visa or not. Appeal for reducing the punishment of a theft crime from jail to fine
Q: A judgement issued today in a criminal case for stealing has resulted in a jail term of three months. An appeal application hearing has been made, in order to turn the jail term into a fine. The appeal date has been set for January 2018, and we were informed that we can make an application to have the appeal heard earlier, is this possible? We would like to convert and pay the fine as soon as possible, in order for the subject to be closed and the accused to have his passport back.2017/10/12
