س: مرحبًا،
أعمل بموجب عقد عمل محدد مدته عامين في شركة ذات مسؤولية محدودة، بإمارة أبو ظبي بصفتي مدير تنفيذي لمبيعات السيارات.
لقد أكملت حتى الآن تسعة عشر شهرًا في العمل لدى هذه الشركة، أرسل لي صاحب العمل خطاب تحذير بسبب الأداء في العمل.
سؤالي هو: هل يحق لصاحب العمل إنهاء خدمتي قبل انتهاء مدة العقد؟ وفي حالة إنهاء خدمتي بسبب الأداء في العمل، هل سأحصل على راتب ثلاثة أشهر وهل سيتم فرض حرمان من العمل علي في هذه الحالة؟
أنا حاصل على درجة البكالوريوس.

What are my rights if I got terminated without a fair reason?
Q: Hello,
I recently got fired for "poor performance" 3 days after one of my co-workers resigned.
I work in a small company that is comprised of 8 employees, the co-worker who resigned makes up for almost all the profit in the company, and also a month before that, we moved to a way cheaper business tower.
2 weeks before I got fired, I received a nice compliment from my boss so I didn't see a reason for that. I also have statistics that show I boosted the company's performance and received a lot of praise from different company branches.
After I received my termination email, a week later my boss still gave me a project to work on. Also multiple times I get texted after working hours.
I also once was going on a vacation and when I went there, I received information that my vacation would be unpaid. Even then I was still receiving text messages from my boss regarding work.
There are a lot of things that happened that I will need to discuss, I could really use some advice.

Do we have to provide a flight ticket to the employee if we terminate him for bad performance?
Q: Hello,
The company terminated the employee for poor performance. He claims the repatriation tickets.
Questions:
1) Shall we cover the cost of repatriation?
Because as per Article 13 (12), if the termination is for a cause, the employee is not eligible for repatriation tickets.
2) If we have to pay, during which period of time we need to provide tickets?

Do I have to pay a penalty if terminated after completing my contract period?
Q: Sir,
As per my contract period, they mentioned that if I leave the company before 1 year, I have to pay 5000 dirhams. But I have already completed more than 1 year and 3 months.
The company has given me a warning letter saying my work performance is low, and if I continue like this, they will terminate me. They didn't mention any charges, but they mentioned in the letter a top penalty procedure.
So I need to know whether I have to pay them any charges or not.

This is regarding an enquiry about a case where we were acquitted by the first instance court, that is, the trial court.
The prosecution appealed the judgment, and we also received an acquittal verdict from the misdemeanour appeal court.
I know there are still 30 days, but what are the chances it can be appealed to the Court of Cassation?

What to do if our landlord keeps ignoring maintenance requests despite a clear contract?
Dear All,
We have a question related to private rental law in Dubai. We have been living in the same house (rented) for the last four years.
During those years, we have had to battle our landlord for maintenance at large. Our contract states that ALL maintenance is on his account (no deductible).
We have a lot of small maintenance issues, such as kitchen cabinets that are coming loose, a sewage smell in the house, and a toilet upstairs that still doesn't work after four years (despite attempted maintenance).
How can we deal with him and get him to honor the contract and resolve all of our issues so we can use the house properly? What legal steps can we take?
We have informed him plenty of times over the four years about the problems, but he seems to "ghost" us and does not reply very often.
We have issued him a warning to get things fixed by the end of this month (via WhatsApp), but he doesn't seem to mind.
Hope you can help with advice and maybe RERA down the line.
