س: أوقف المقاول من الباطن العمل مستندًا في ذلك إلى المادتين 246 و 247 من القانون المدني الإماراتي بسبب تأخر المقاول الرئيسي في السداد (الدفع المسبق والمدفوعات المؤقتة).
لكن ما يشغل اهتمام المقاول الرئيسي هو أنه لم يستلم المستند المطلوب (وهو ضمان البنك القدم) لمعالجة الدفعة المقدمة في الوقت المحدد ولم يتم الاتفاق على مسودة خطاب الاعتماد الذي تم إصداره إلى المقاول من الباطن في الوقت المحدد نظرًا لوجود العديد من الخلافات حول بعض ما فيه.
دفع المقاول الرئيسي الدفعة المقدمة إلى المقاول من الباطن في غضون 90 يومًا من استلام ضمان البنك المقدم مرجعًا سبب التأخير إلى إعادة تخصيص المال بسبب التأخير في تقديم الضمان البنكي المقدم واتفاقية مسودة خطاب الاعتماد.
إذا أراد المقاول الرئيسي فرض عقوبة بسبب التأخير من قبل المقاول من الباطن، فمن الذي حجته ستؤخذ في الحسبان؟

س: قامت شركتنا (تابعة للمنطقة الحرة في إمارة عجمان) بتسليم بضائع إلى إحدى الشركات في البر الرئيسي بدبي.
اتفقنا على دفع 30٪ عند تأكيد الطلب و70٪ عند تسليم البضائع إلى المستودع في إمارة دبي.
دفع العميل 30٪ عند تأكيد الطلب وتخلف عن دفع 70٪ عند تسليم البضائع إلى المستودع الخاص به. عند مواجهة العميل بعدم امتثاله لشروط الدفع، طلب الدفع على أقساط.
اتفقنا على خمسة أقساط شهرية وأكد العميل تاريخ الدفعات وقيمتها عبر البريد الإلكتروني.
أكتوبر 2020، ونوفمبر 2020، وديسمبر 2020، ويناير 2021، وفبراير 2021.
ولكنه لم يدفع الشهور ديسمبر 2020 ويناير 2021 وفبراير 2021.
ومنذ ذلك الحين يتجنب التواصل معنا، وعندما نواصل الضغط عليه، يدفع مبالغ صغيرة لا تساوي الأقساط الشهرية المتفق عليها.
تم تأكيد الأقساط، لكنه لم يقدم شيكات مؤجلة الدفع.

Q: Dear Sir/Madam,
A total of 3 consignments of spices were exported to a Dubai-based company. The payment terms were 50% against AWB and the rest after 15 days of delivery. After the delivery of the 2nd transaction, we got the first part of the payment.
Upon sending the 3rd consignment, the company complained of quality issues in the product shipped in the second consignment (after 14 days of delivery) and released the 50% payment for the third consignment also.
No further discussions were made regarding the second consignment's quality. They assured to release the payment as per payment terms.
As soon as the third consignment reached, they again complained of quality issues about the size of the product. We asked them to return the goods and not sell them further.
They have sold the goods and after 20 days, are demanding a lab test on a very small quantity of goods remaining with them and are not releasing payments.
What laws apply to the sales of goods and their payments?
What recourse do we have?

My work starts at 7:30 am and then finishes at 10 pm or less. It depends on whether the baby is asleep or what time they will take on me if not yet asleep. Is this right?
Also, at the time of eating, I'm still working because the baby is with me, so I just let her sit in her chair. That's how I eat.

What can I do if I got a judgment in absentia for selling medicine without a license? 0
I got an order of 6 months imprisonment and deportation for a judgment in absentia by the Sharjah court for selling medicine without a license. I was not involved in the case directly; my friend used my car, and he had my bank card.
They made a confession that they were working for me and made a false claim that they had transferred money to me. As I am outside the country, I came to the UAE to solve my case.
I got detained at the airport, and the CID asked me some questions. I mentioned they didn’t transfer me a single Dihram, so he let me go, as the case was already open for appeal.
In the first instance court, they gave me the same verdict, then I appealed and attached documents like bank statements and my company details, which were not mentioned before.
They gave a date for the judgment, but it was not issued, and they gave the next date. I have been suffering a lot for the last 3 months here in the UAE and for 6 months back home.
So my question is that what will happen next?
Will the case be open for retrial, and will the CID be convinced by my logic?
Can they drop charges, or now the court decide only?

Hi,
I am a non-Muslim indian expatriate, residing in Dubai since 2015. The first 5 years, I was on a working visa, and after the delivery of my first baby, I left my job and became dependent on my husband.
In 2018, we bought a house together where I invested AED 2 hundred thousand from my income (I have proof in the form of a cheque). I also paid AED 3300 monthly installment for 1 year, for a personal loan taken out for the house.
But in spite of my resistance, my husband tactfully put the house in his name, so the title deed was in his name. In 2024, when my kids and I were in India for vacation, he cancelled our visas and residency. He also filed for a divorce in India.
The divorce is not yet finalised, and we are still married. Since August 2024, he hasn't let me access my house in Dubai, so I filed a case, which eventually went in my favor in January 2025.
Since I used to travel on a visit visa, I left for India and returned in March, to find out that my husband had already sold the house. The new owner is residing there.
What can I do now?
