Am I entitled to ticket money if I was terminated before completing two years?

Hello,

I got terminated, and they sent me the settlement letter.

Am I not eligible for the ticket money, even though I didn’t finish two years before they terminated me?

Greetings,

Your entitlement to a return ticket depends on your employment contract and UAE Labour Law. Generally:

- If your contract states that the employer must provide a return ticket upon termination, they are obligated to do so.

- If your termination was arbitrary or without cause, you may have additional claims.

- Some contracts or company policies may only cover the ticket after completing two years, but this can be challenged in certain cases.

Dear questioner,

An employee is entitled to a return ticket to their home country if their contract is terminated by the employer, unless they secure a new job.

The length of service does not affect this right. It is advisable to review your employment contract and company policy for any additional terms.

According to UAE labor law, specifically Article 13(12) of the Employment Law, employers are generally obligated to cover the cost of an employee's repatriation to their point of origin.

This typically applies upon termination of the employment contract. However, there are exceptions.

If an employee secures new employment within the UAE, or if the termination is due to the employee's misconduct, the employer may not be required to provide a repatriation ticket.

If you need further clarification, you may ask us.

Dear Sir/Madam,

Thank you for your inquiry regarding your eligibility for a repatriation ticket following your termination. Based on UAE labor law, I can provide the following professional advice:

1. Legal Entitlement:

According to Article 13 of the UAE Labor Law, employers are required to cover the expenses for an employee's repatriation to their place of origin or an agreed-upon location upon termination of employment.

2. Eligibility Criteria:

- You are generally eligible for a repatriation ticket if your employment was terminated by your employer, except in cases falling under Article 44 of the UAE Labour Law.

- Your intention to return to your home country is a key factor in this entitlement.

3. Length of Service:

The law does not stipulate a minimum service period for repatriation ticket eligibility. Therefore, not completing two years of service should not, in principle, affect your entitlement.

4. Settlement Letter:

Review your settlement letter carefully to ensure it includes provision for your repatriation ticket. If this is not mentioned, you should bring this to your employer's attention.

5. Next Steps:

If your employer disputes your eligibility for a repatriation ticket, you may need to:

a) Formally request the ticket in writing, citing the relevant labor law.

b) If unsuccessful, consider filing a complaint with the Ministry of Human Resources and Emiratisation (MOHRE).

Given the specifics of your situation, it would be advisable to consult with a legal professional specializing in UAE labor law for personalized advice, especially if you encounter any resistance from your employer.

If you require any further clarification or assistance, please don't hesitate to ask.

Yours sincerely,
