Hello,

A landlord must provide a minimum notice period of 12 months if they wish to evict a tenant for the purpose of using the property for their own personal use.

Article (25) of Law No. (33) of 2008 Amending Law No. (26) of 2007 Regulating the Relationship between Landlords and Tenants in the Emirate of Dubai:

If the owner of the property wishes to recover it for his personal use or for the use of any of his relatives up to the first degree, provided that it is proven that he does not own a suitable alternative for that purpose.

For the purposes of Clause (2) of this Article, the landlord must notify the tenant of the reasons for vacating the property at least twelve months before the date specified for eviction, provided that notification is made by notary public or registered mail.

Article (26):

If the committee rules for the landlord to restore the property for his personal use or for the use of any of his relatives up to the first degree in accordance with the provisions of Paragraph (C) of Clause (2) of Article (25) of this law, he may not rent it to others except after at least two years have passed with regard to residential real estate and three years for non-residential properties from the date the landlord regains the property, unless the committee rules a shorter period for reasons it determines. Otherwise, the tenant has the right to request the committee to award him compensation.

In Dubai, the minimum notice period a landlord must give a tenant before evicting them for personal use of the property is 12 months.

This is stipulated under Article 25(2) of Law No. 33 of 2008, which amends Law No. 26 of 2007 Regulating the Relationship Between Landlords and Tenants in the Emirate of Dubai.

The law states:

Upon expiry of the tenancy contract, the landlord may demand eviction of the tenant if he wishes to use the property himself or by his first-degree relatives, provided that he proves that he does not own a suitable alternative property for that purpose. In such cases, the landlord must notify the tenant with a notice of no less than twelve (12) months before the eviction date, and this notice must be sent through a notary public or registered mail.

This provision ensures that the tenant has adequate time to make arrangements and find alternative accommodation. It is essential for the landlord to comply strictly with the 12-month notice requirement and to demonstrate genuine intent to use the property personally or for their first-degree relatives.
