Can a 70-year-old facing a rental case get a waiver for unpaid rent due to age and financial hardship?
Asalmu Alaikum,
Dear Honorable Lawyers!
I have a question regarding a 70-year-old man who has a rental case in Ajman involving 20,000 dirhams. He has paid 10,000 dirhams, leaving 10,000 dirhams still due.
This poor elderly man’s visa has expired, and due to his age, he is unable to find work and has no money for food. How can he resolve his rental case and pay the remaining amount?
He has not returned to his home country, Pakistan, for the past 11 years. Is there any law in this country that allows for the waiver of outstanding rent?
If something happens to him because of these 10,000 dirhams, or if he passes away here, who will be responsible?
Kindly let me know if a waiver application can be submitted for this amount and whom to contact for assistance. Who can help him in this matter, as he has no money?
Thanks!
Dear Questioner,
Unfortunately, there is no specific law in the UAE that guarantees automatic waiver of remaining debts due to age or financial circumstances, but there are some steps that can be taken to support this elderly man:
- Negotiate with the landlord:
A request can be submitted to the landlord to reconsider the amount owed, especially when attaching documents proving his financial inability and health conditions. In some cases, the landlord may agree to waive or reduce the amount.
- Submit a humanitarian exemption request:
You can go to the relevant court in Ajman to submit a request on humanitarian grounds, attached with reports on his financial and health condition. The court may, in some cases, take into account these circumstances to reduce the sentence or extend the repayment period.
- Assistance from charities:
Some charities and non-profit organizations in the UAE provide support for humanitarian cases, and they can help settle this type of debt.
- Pakistani Embassy:
You can contact the embassy for support or guidance regarding his case, as the embassy may be able to provide assistance in these circumstances.
If the request is submitted correctly with the necessary documentation, there may be hope for a satisfactory settlement.
