How to settle payment in a rental enforcement case at RDC and remove travel ban?

Hi,

I would like to have a suggestion from one of your lawyers.

There is an enforcement case against me in RDC Dubai for my rent of AED 44000. The court issued a travel ban for me.

I want to pay but due to my financial situation as all my business was destroyed, we are losing too much this year.

I want to remove my travel ban.

What should I do?

Thank You!

Negotiate with the landlord, and if he agrees to lift the travel ban, then the judge will approve.

Dear Inquirer

We are pleased to serve you and address your inquiries.

You can submit a request for installments to the judge, but the travel ban will only be lifted by full payment.

In the event of exile, in order to remove the travel ban, a guarantor capable of paying the debt must be provided.

If anything else is required, don’t hesitate to contact us via email or call our offices in Dubai or Sharjah.

Dear Questioner,

Thanks for your inquiry.

Regarding the above, we would like to inform you that, before initiating the legal process, we will require a Power of Attorney (POA) from you.

This is necessary for us to represent you before government authorities and police stations. To proceed with the notarization of the POA, kindly provide us with the following documents:

- Copy of your old and new passport

- Copy of your Visa

- Copy of your Emirates ID

Upon receiving the aforementioned documents, we will begin drafting the POA in bilingual form. We will then send it to you for review, signature, and return.

Subsequently, we will submit the request to the federal Notary Public to notarize the POA. The Notary will provide a link for a remote meeting, during which your original passport will be verified, and you will sign on the screen.

Following this, we will cover the fees for Notary legal expenses and obtain a digital copy of the notarized POA. Please be advised that the legal fees for the POA notarization process amount to USD 140.

Upon receipt of the digital notarized POA, we will proceed to check your criminal record in the UAE to determine if there are any cases registered in your name.

Please note that this process will take approximately 4 working days and our professional legal fees for this service amount to USD 320.

Regards,

It is important to address the enforcement case against you as soon as possible to avoid any further legal consequences.

Here are some steps you can take:

1. Contact the landlord or their representative: Try to negotiate with them and explain your financial situation. See if they are willing to come to a payment agreement or reduce the amount owed.

2. File a request to lift the travel ban: You can file a request with the court to lift the travel ban. This will require you to provide proof of your financial situation and a valid reason for lifting the ban.

It is important to note that the court may not lift the ban if you have not made any effort to resolve the case.

3. Attend court hearings: If the case goes to court, it is important to attend all hearings and present your case. The court may consider your financial situation and may reduce the amount owed or allow for a payment plan.

4. Settle the debt: If possible, try to settle the debt with the landlord or their representative. This will help in resolving the case and lifting the travel ban. It is important to take action as soon as possible to avoid any further legal consequences.
