How do I evict a tenant from a commercial property I purchased for personal use?

If I purchase a commercial property with a tenant but wish to evict the tenant for my own personal use, what is the process, and how much notice do I have to give them?

If your property is located in Dubai, you have the right to evict a tenant in order to use the commercial property for your own personal use.

However, there are specific legal requirements that must be followed to ensure the process is carried out correctly.

Firstly, you are required to serve the tenant with a formal legal notice. This notice must be issued through a notary public. The purpose of the notice is to inform the tenant of your intent to reclaim the property for personal use.

The notice must give the tenant a full twelve months' warning before they are required to vacate the property.

This period is designed to give the tenant adequate time to arrange alternative premises. It is essential that this notice is clear, legally valid, and properly communicated to the tenant in accordance with the law.

Additionally, you will need to demonstrate that you do not have any other suitable alternative property that you can use, and that your need for this specific property is genuine.

This requirement is in place to prevent unjustified evictions and to ensure that property owners are acting in good faith when seeking to reclaim property for personal use.

The fees for issuing and serving a legal notice through the notary public are approximately 500 AED. This covers the cost of the formal notice required to inform the tenant of your intention to reclaim the property.

In the event that the tenant refuses to vacate the property at the end of the notice period, you may need to file an eviction lawsuit with the Rental Dispute Centre (RDC).

The fee for filing this lawsuit is 3.5% of the annual rental contract value. This legal step is necessary to enforce the eviction if the tenant does not comply voluntarily with the notice.

If this is in Dubai, then you have to send an official eviction notice (through the notary) for a period of 12 months.

If the tenant is non-Arab, the notification must be in Arabic and English, then after 12 months from the date of receipt of the notification by the tenant, he has to be evicted.
