لقد خسرنا قضية إخلاء في دبي ويطالب مالك العقار برسوم المحكمة. وتتجاوز هذه التكاليف رسوم التسجيل في المحكمة بمبلغ 3000 درهم (رسوم الطباعة، رسوم الترجمة، إلخ).
ويطلب أن يدفع له مباشرة. لقد دفعنا الإيجار بالفعل وحددنا موعدًا للخروج.
هل أحتاج لدفع هذه الرسوم؟
وهل يجب عليه فتح ملف تنفيذ للمطالبة بها؟

What's next if a tenant won't pay or vacate despite winning the case in RDC court?

Q: Dear Sir/Madam,
The tenant didn't pay rent for over 7 months. I filed a case, and finally won; the RDC court verdict is to evict the tenant and for them to pay all rent and legal fees.
I contacted the tenant, who refused to move out or pay. What's the next step? Do I file for execution via RDC, or will it be automatic? How much does it cost, and how long does it take?
The tenant is arrogant and said he will not pay until I proceed with execution from RDC, and then he will ask for a one-year payment plan!
The whole procedure is very unfriendly to the landlord, with the tenant risking nothing while the landlord incurs lawyer fees, interest losses, and significant time and effort.

س: سيدي العزيز / سيدتي العزيزة،
أرسل لي مالك العقار إشعارًا قبل 95 يومًا من انتهاء العقد بأن الإيجار قد زاد بنسبة 40% دون أي مبرر. أبلغت المالك بأنه يجب علينا الالتزام بحاسبة مؤسسة التنظيم العقاري وأرسلت له نصًا منها حيث مذكور بوضوح على عدم وجود زيادة في إيجار العقار.
بعد المراجعة بيننا عدة مرات، قررت زيارة مركز فض المنازعات الإيجارية. لقد اقترحوا تقديم عرض وإيداع وتمت الموافقة عليهما وفقًا لحاسبة مؤسسة التنظيم العقاري.
لقد أرسلت الشهادة إلى المالك فأجابني بأنه يرفض ذلك.
ماذا علي أن أفعل بعد ذلك؟
هل يمكنني الحصول على إيجاري مع العرض وشهادة الإيداع؟ أو هل أحتاج إلى عقد إيجار بتوقيع المالك؟

I rented a studio on a monthly basis, and my rent included all utilities and bills, with a contract that isn’t Ejari.
Now, the landlord has cut off the DEWA and is asking me to vacate the unit and take the rest of my rent three months before the contract expires.

Addendum:
1. In case of not renewing the contract, the tenant shall inform the landlord 3 months prior. If the tenant fails to do so, they shall bear a penalty of 2 months' rent for not notifying the landlord.
2. Failure to execute the renewal (at the sole discretion of the landlord) shall result in the automatic termination of this agreement.
3. The landlord unequivocally objects to the tenant's continued occupation of the premises after the expiry of this agreement. An overstay fee shall apply from the day following the expiry of the term. The tenant’s continued occupation shall not result in the automatic renewal of this agreement.
Questions:
A. Does this addendum supersede the laws of the Real Estate Regulatory Agency (RERA)?
B. Does the contract automatically renew, or is it considered terminated as per the conditions of the addendum?
C. How much should be paid to the landlord if the tenant vacates a week after the expiry of the contract?

I was driving my car when the police stopped me at one point on the road and told me that I was driving under the influence of alcohol.
I tried hard to deny that because I had not actually consumed any alcoholic beverages that day or in the previous three days.
However, a report was filed and a case was opened, but the alcohol test report came back negative. Will I be convicted despite that?

We have an agreement with a company to supply food for their buffet on a daily basis, with invoices to be issued monthly and payment to be made every three months.
The relationship actually lasted for nine months, and payment was made for two periods. In the third period, due to disagreements between our company and the company to which the supply was made, they refused to pay, noting that the outstanding amount so far is fifty-four thousand dirhams.
Can we claim the amount, noting that the agreement is not written, but there are emails exchanged between us and invoices?

We won the case with the RDC that the tenant has to evict the property. We are told there is a cooling period before they say the date he has to leave.
How long is the cooling period he can appeal and then what happens next if he appeals and if he doesn't?
