Should an employer pay for maternity leave during the 6-month probation period?

Dear Lawyers,

If a female employee joins an organization and goes on maternity leave within the 6-month probation period, is the employer supposed to pay for the maternity leave?

Is there a required time duration that employees must complete in the organization to be eligible for maternity leave pay?

1. Maternity Leave Entitlement:

Female employees are entitled to 60 days of maternity leave:

- The first 45 days with full pay.

- The remaining 15 days with half pay.

2. Employer's Obligation:

The employer is obligated to pay the maternity leave as per the standard rules, regardless of the probation period.

Terminating an employee during maternity leave, or denying maternity benefits on the grounds of probation, would generally be against UAE Labor Law and could lead to legal consequences for the employer.

Dear Questioner,

A female employee appointed to a permanent position is entitled to maternity leave for a period of (90) days, starting from the date of birth.

Maternity leave may be combined with periodic leave and unpaid leave, provided that the total of these leaves, in the event of combination, does not exceed (120) days.
