Can I back out of a signed employment contract before starting work or visa processing?

Hi,

I signed an employment contract but haven't started yet as I am still serving my notice period at my current company. My visa has not yet been processed, and I am still on my current company's visa.

Now I don't want to continue with the other company. Do I face any legal obligations?

Dear Questioner,

Since you haven't started the new job and the company hasn't incurred any visa-related costs, your position is stronger when negotiating the termination of the contract.

You may get in touch with them and explain your situation.

Be prepared to discuss the reasons for your decision and express your apologies if necessary.

Hi,

You should send them a notice indicating that you don't want to continue with the contract.

As long as you haven't started executing the contract yet, and even if you have started, there's a probation period during which you can terminate the contract with a 14-day notice.

Thank you!

Dear Questioner,

These legal matters depend on several factors:

1. The Signed Contract:

Employment contracts typically include terms related to termination and the obligations of each party if the employee does not start work. Review the contract to understand any clauses regarding withdrawal or termination before starting work.

2. Your Obligations to the New Company:

If you decide not to proceed with the new company, you may be required to pay compensation or a penalty as stipulated in the contract, if such terms are included.

3. Legal Procedures:

If you have not started work and the visa has not been issued, legal obligations may be less compared to a situation where the employment contract was already in effect. However, the new company might pursue a claim if it has suffered damage, depending on the contract terms.

4. Communication with the New Company:

It is best to inform the new company of your decision as soon as possible to reach an amicable agreement if possible, to avoid any legal disputes or claims.

If you need specific legal advice based on the contract details or situation, you can contact us for specialized legal advice.

Alternatively, leave your phone number, and the relevant department at our law firm will get in touch with you.

Greetings,

As long as you did not sign an official contract, you will not face any problems. You can resign and tell them that you do not want to work with them.

For further inquiries about your topic, you can come to our office or contact us via phone, WhatsApp, or email.

Dear Questioner,

While you generally do not face significant legal obligations after signing an employment contract but before starting work, especially if no specific penalties are outlined, you should carefully review your contract and consider labor laws.

Open communication with both employers will also help mitigate any potential issues arising from this situation.
