Is a rent increase valid if the notification comes from an unlisted email address?

Dear Lawyers,

If the landlord's property management company has sent a rent increase notification from an email address that does not match the one listed in the contract for the landlord, will this notification be considered valid for a rent increase?

Dear Questioner,

If the rent increase notification is sent from an email address that does not match the one listed in the contract for the landlord, it may raise doubts about the authenticity and validity of the notification.

In such a situation, it is advisable to verify the legitimacy of the communication directly with the landlord or the authorized property management company using the contact information provided in the lease agreement.

To ensure that the rent increase notification is valid and legally binding, it is best to request confirmation through verified communication channels and seek clarification from the landlord or their authorized representative.

This can help prevent any misunderstandings or potential issues regarding the proposed rent increase.

Thank you, madam, for your response!

The email is legitimate from the management company. However, my question is whether the rent increase will be considered valid since the email address does not match the one listed in the Tenancy Contract and Ejari.

If the email regarding the rent increase is confirmed to be legitimate from the management company, the validity of the rent increase may not be solely determined by the email address discrepancy.

The key factors to consider include whether the rent increase complies with the terms and conditions outlined in the official lease agreement and whether proper notification procedures as per Dubai's rent laws have been followed.

Got it. The rent increase notification is for 40%, but according to the RERA calculator, the maximum allowed for my tenancy contract is 10%.

How do I file a complaint about this?

To file a complaint about an excessive rent increase:

1. Gather relevant documents.

2. Contact RERA for the complaint process.

3. Submit a formal complaint with supporting evidence.

4. Follow up with RERA.

If they have previously dealt with you through that email, it is valid and the court will accept it.

The law considers the purpose of anything, not just the form.

Thanks, Ahmad for your response!

How do I deal with a 40% rent increase notification?

8 Aug 2024, 12:49

The maximum increase is 20%, and this is the limit.

It depends on what the rental index says and the current rental amount.

This is in Dubai; I don’t know about the other cities.

OK, thanks, Ahmad!

Dear Questioner,

The validity of a rent increase notification is generally not determined solely by the email address used.

While it might seem unusual that the property management company used a different email address, the primary focus should be on the content of the notification and whether it complies with the legal requirements for rent increases.

If you want, you can deny it based on the reason mentioned in the tenancy contract.
