س: ما هي إمكانية إنهاء اتفاقية البيع والشراء الموقّعة مع المطور العقاري في إمارة دبي عن طريق المحكمة في حالة: 1. موعد التسليم المقرر كان في الربع الأول من عام 2017 بالإضافة إلى فترة سماح مدتها 12 شهرًا. 2. بناءً على المعاينة بتاريخ 02/2019، لقد اكتمل المشروع بنسبة تزيد على 93٪. 3. من المحتمل أن يكتمل المشروع قبل البدء في إجراءات القضية أو أثنائها ولكن من المحتمل أيضًا أن يتأخر المشروع أكثر على الأقل لعدة أشهر. 4. وفقًا لاتفاقية البيع والشراء "لا يعتبر البائع مقصرًا أو مخالفًا لالتزاماته... بقدر ما يتم منع الوفاء بهذه الالتزامات... بسبب تأخيرات الطرف الثالث... أو بسبب تمديد الوقت الممنوح إلى المقاول الرئيسي من جانب المهندس الاستشاري... لأي سببٍ كان". على الرغم من أنه من المحتمل أن يكون سبب التأخير هو البائع أو لأسباب تقع ضمن سيطرته (على سبيل المثال، تأخير المدفوعات للمقاول)، كيف يمكن للمدعي الوصول إلى هذه الأدلة وهل هذه المسألة مهمة بالنظر إلى النقاط رقم 2 و4؟
