Can I sue if evicted for personal use but the property is re-rented under the landlord's son?

Dear Lawyers,

I was evicted on the grounds that the landlord needed the property for personal use. The landlord has rented the property out again at a higher rent but under his son’s name.

Can I still sue for compensation?

Greetings,

Yes, you can file a lawsuit and claim compensation if he rented the property and did not sell it as he claimed when he evicted you from it.

Dear Questioner,

Thanks for your inquiry!

Regarding the above, we would like to inform you that, according to UAE law, if a landlord evicts a tenant on the grounds of personal use, they must provide evidence that they or their immediate family members will be residing in the property.

If the landlord has rented the property out again at a higher rent under their son's name, it could be considered a violation of the law.

You may have grounds to sue for compensation if you can prove that the landlord did not actually need the property for personal use and that they evicted you in order to rent it out at a higher price.

You can file a complaint with the Rent Dispute Settlement Committee in your emirate and provide evidence to support your claim.

It is important to note that the outcome of your case will depend on the evidence you provide and the decision of the committee.

It is recommended to seek legal advice from us as a lawyer who is familiar with UAE rental laws to determine the best course of action in your situation.

Kindly do not hesitate to contact us at [------] for further guidance.

Greetings,

Hello,

Yes, you likely have the grounds to sue for the compensation.

In the UAE, if the landlord evicts the tenant for personal use but then rents the property out again within 2 years, the tenant has the right to claim compensation.

Gather any evidence showing the property is rented again. Then consider filing a complaint with RDC.
