Can the landlord send an eviction notice by email if I refused rent increase?

My rent contract ends on 9/8/2024. I contacted the landlord for renewal and he asked to increase the rent. He didn’t send any notice for an increase before 90 days, so I declined the requested increase.

He called and said I should accept the increase or I have to leave. One day later, yesterday, he sent me (email) a notice to evict the apartment for selling, and he wrote he would provide a partial contract until 28 May 2025.

Since I asked before in an email to share a copy of his EID, he used the same email subject to share the eviction notice. Can he do that before the contract renewal?

He was willing to renew with higher rent and when I refused, he came with an eviction notice.

What if pretends to sell it but doesn’t sell (shifts the ownership to wife)?

How to check if it's sold?

Can he send the eviction notice through email or should be through registered mail?

If emails are accepted, can he send them under another email subject (subject used: a copy of EID or passport)?

What should I do next?

Thanks

Dear I.,

The 12-month notice must be bilingual if you are not an Arabic speaker and it should be notarized and sent to the address by post or registered email by Aramex.

Further, if the landlord leases the property, then you can file a compensation case against the landlord.

Please contact me on the phone to discuss this matter in detail.

Dear questioner,

The landlord shall serve a legal notice of eviction either through a notary public or via registered mail instead of through personal mail.

Also, transferring the property to the name of a near relative will not be construed as a sale as per Dubai rental laws.

You are not required to vacate the apartment unless you receive a formal eviction notice.

Dear Questioner,

We can assist you in determining if such an increase requested by the landlord is aligned with DLD requirements.

Also, the landlord has no right to evict you because you do not accept the increase if it is not aligned with DLD.

Did the notary notarize the legal notice?

Dear Questioner,

The rent should be increased as per the RERA index only. And if he re-rents the property, then we can file a strong case against him.

Please reach our senior legal consultant Mr.Muhammad Abdullah on WhatsApp at [-----] for further details.

Dear Questioner,

The eviction notice must be given by a notary public and not by email.

The sale must be real. If the apartment is vacated and the sale is not completed, the owner may not rent it again except after notifying you of that. If he does not, you can demand compensation from him.

If anything else is required, don’t hesitate to contact us via email or call our offices in Dubai at [-----] or Sharjah at [-----].

Hello,

Thank you for reaching out!

According to Dubai rental laws, any rent increase must be communicated by the landlord at least 90 days before the contract renewal date, unless otherwise agreed in the contract. This notice can be sent via email or other means.

Regarding the eviction notice for selling the property, the law requires the landlord to serve this notice through a notary public or registered mail, and it must provide a 12-month notice period.

The landlord must also prove the intent to sell. If it is found that the property is re-leased to another tenant after you vacate, you may be entitled to compensation.

Additionally, if the landlord issues an eviction notice for the purpose of selling, he must genuinely sell the property.

He cannot transfer ownership to a relative, such as his wife, as this would not constitute a sale and could make him liable for compensation.

If you received the eviction notice via email under a different subject, it is crucial to determine if this method is legally acceptable. eviction notices for selling must be served formally.

To verify if the property is sold, you can check with the Dubai Land Department or we can assist by contacting [-----].

Dear Questioner,

It seems like your landlord is attempting to evict you under the guise of selling the property, possibly in response to your refusal to accept the rent increase.

Here are some points to consider and steps you can take:

1. Notice Period:

In Dubai, landlords are required to provide tenants with a notice period of at least 12 months before the end of the tenancy contract if they intend to sell the property and terminate the lease. Your landlord should have provided you with a formal eviction notice adhering to this requirement.

2. Proof of Intent to Sell:

Your landlord must provide evidence of their intention to sell the property, such as listing it with a real estate agency, putting up a "For Sale" sign, or providing a formal sales agreement.

3. Email Communication:

While email communication is generally accepted for correspondence, legal notices such as eviction notices should ideally be sent through registered mail or delivered in person to ensure proper documentation and receipt.

4. Verification of Property Sale:

You can check if the property has been listed for sale by searching online property portals, contacting real estate agencies, or checking with the Dubai Land Department for property transactions.

5. Consult a Legal Advisor:

Consider seeking advice from a legal advisor or a tenant rights organization in Dubai to understand your rights and options in this situation. They can provide guidance on how to respond to the eviction notice and protect your rights as a tenant.

6. Document Everything:

Keep records of all communications with your landlord, including emails, texts, and any other correspondence related to the rent increase and eviction notice. This documentation may be useful in case of any legal proceedings.

7. Negotiation:

If possible, try to negotiate with your landlord to find a mutually agreeable solution, such as a reasonable rent increase or an extension of the tenancy contract.

It's essential to act promptly and seek appropriate legal advice to ensure your rights are protected throughout this process.

Hello,

I'm Sakina Dickenwala from MBC Legal.

Thank you for your inquiry!

As per UAE regulations, landlords are obligated to furnish tenants with a written notice regarding any rent increase at least 90 days prior to the expiration of the tenancy contract.

Failure to adhere to this requirement grants the tenant the right to reject the increase and maintain the current rental rate.

In your situation, it appears that the landlord bypassed the proper protocol for rent adjustment and instead issued you an eviction notice.

Such actions are not permissible under the law, affording you the right to contest the eviction notice.

Firstly, it's advisable to review your tenancy contract for any clauses permitting the landlord to evict you for a property sale.

The absence of such a provision renders the landlord incapable of evicting you on these grounds.

Secondly, you can request evidence of the property's sale from the landlord, typically in the form of a sale agreement or transfer of ownership document.

Failure to furnish such proof renders the eviction notice invalid. For sale as well, the landlord must give a notice of 1 year.

Thirdly, eviction notices must be dispatched via registered mail or delivered personally; email correspondence is not deemed a valid form of notice unless explicitly stated in the tenancy contract.

Lastly, if the landlord persists in the eviction attempt, lodging a complaint with relevant authorities like the Rental Dispute Settlement Center is an option to resolve the matter.

Maintaining thorough records of all communication with the landlord, including emails, is crucial throughout this process.

In any rental issue, specify the city because rental laws in the Emirates are not uniform, and each city has its own rental laws.
