Is email eviction notice considered legally accepted notification?

Hello,

Landlord sent an eviction note by email asking to confirm it by email as well. I already confirmed by email that I received her email. It has been 12 months and she is claiming that she wants to move into the apartment.

I read several threads; some say that her claim does stand as it is similar to registered mail, while others say it has to be an official registered mail.

From common sense, the landlord did get a confirmation that the tenant acknowledges receipt of the intent of eviction. From a literal legal perspective, she did not use registered mail.

I suspect that this situation is frequent and I would like your experience based on what is recently happening in courts, and not only an interpretation of the law, as the concern is that two judges might interpret this part of the law differently.

Dear Questioner,

According to Article (25/1) of the Law Regulating the Relationship between Landlords and Tenants of Real Estate in Dubai, the landlord may request the eviction of the tenant from the leased property after notifying him through a notary or registered mail.

Dear Questioner,

If you are asking about the rental law in Dubai (each emirate has a different rental law), the notice to vacate the property should be by registered mail or by a notary.

Email is not acceptable for eviction.

And in that law, the email can be accepted in other notices, for example, the rent increase, and not in the eviction.

Dear Questioner,

In that case, if you confirmed the receiving of the notice, it will be accepted in the court, but if there’s no confirmation or acceptance, this notice will be invalid.

Anyway, my advice to you is to deny this notice as it should be given by the notary public and not by email.

There is an option that the judge will not accept the notice she sent so far and she has to notify you for another 12 months.
