An apartment's access card is deactivated due to unpaid rent. What if reported to the police?

Dear Sir/Madam,

The tenant in my hotel apartment property did not pay rent, and the access card was deactivated.

The tenant reported it to the police.

What can the police do if they take it up?

Dear Questioner,

They will ask you to go by the legal way.

It is better to file a rental dispute and we will assist you in this issue.

Hello,

I'm Sakina Dickenwala from MBC Legal.

If the tenant has not paid rent and the access card has been deactivated, the landlord has the right to take legal action against the tenant.

The police can assist with this matter by mediating between the landlord and tenant, but they do not have the authority to force the landlord to reactivate the access card or to force the tenant to pay rent.

The police may also advise the tenant to vacate the property if they are unable to pay rent.

If the landlord wishes to pursue legal action, they can file a case with the Rental Dispute Settlement Center or the Dubai Courts.

It is important to note that the landlord must follow the proper legal procedures and cannot take any action against the tenant without a court order.

We are here for a quick call and a meeting to discuss further.

Kindly contact us via phone or email for further assistance.

Hi,

We advise you to take legal action quickly by serving a legal notice for eviction and claiming the due amount.

We can also represent you before the police if the tenant decides to file a claim.

Is he still not able to access the unit?

Hi,

The police can't do anything, so it's better to send him a legal notice to pay. If he doesn't pay within the time limit, you can file a case to evict him, with all due rent paid.

We can help you by sending the legal notice. Just contact us via phone.

You are not allowed to prevent him from entering the apartment.

If he doesn't pay rent, you can file a rental dispute case against him.

Hello,

It sounds like you're dealing with a frustrating situation.

The police may issue a report confirming an incident in favor of the tenant, which could lead to a potential lawsuit and compensation claim against you.

Hello,

If it's a holiday home, the tenant has signed the terms and conditions, and there is no security deposit to be collected from the tenant, you can file a complaint with Dubai Tourism.

If you have any further clarifications, please share your WhatsApp number to discuss the same.

Dear Questioner,

Thank you for reaching out to me regarding the dispute with your tenant over unpaid rent and their report to the police.

I understand that this situation can be concerning, but rest assured, I am here to provide you with guidance and support.

In Dubai, disputes between landlords and tenants are governed by specific laws and regulations outlined in the Dubai Land Department (DLD).

Regarding your tenant's failure to pay rent and subsequent involvement of the police, it's important to understand the legal implications and potential courses of action.

If the tenant has not fulfilled their contractual obligation to pay rent, you as the landlord have certain rights under the law.

However, it's crucial to handle the situation in accordance with the legal procedures to avoid any complications or legal repercussions.

In response to your specific question about the involvement of the police, the Dubai Police may intervene in cases where there are allegations of criminal behavior, such as theft, vandalism, or trespassing.

However, disputes related to unpaid rent are typically considered civil matters and may not fall under the jurisdiction of the police unless there is evidence of criminal activity.

To address this situation effectively and protect your rights as a landlord, I recommend taking the following steps:

- Review the Tenancy Contract:

Examine the terms and conditions outlined in the tenancy contract signed by both parties, including provisions related to rent payments, late fees, and dispute resolution procedures.

- Communication with the Tenant:

Attempt to resolve the issue amicably through communication with the tenant. Document all correspondence and efforts made to collect the overdue rent.

- Legal Notice:

If the tenant continues to default on rent payments, consider sending a formal legal notice requesting payment within a specified period. This notice serves as a legal document and may be used as evidence in further legal proceedings.

- Legal Recourse:

If the tenant fails to respond to the legal notice or refuses to pay the outstanding rent, you may explore legal options such as filing a case with the Rental Dispute Settlement Center (RDSC) or seeking assistance from a legal advisor to initiate legal proceedings.

Please note that each case is unique, and the appropriate course of action may vary depending on the specific circumstances.

As your legal advisor, I am available to discuss your situation in further detail and provide personalized guidance tailored to your needs.

Please feel free to contact me via WhatsApp or phone [----------] to schedule a consultation and discuss your options further. I am here to assist you every step of the way.
