Bought rented property, tenant not paying or responding. What now?
Dear Sir/Madam,
I recently purchased a rented property, however, the tenant is not paying rent or responding.
There is no registered Ejari with the previous owner.
Dear client,
You must send a legal notice to the tenant to pay the rent to you as the new owner.
If he does not respond, you can file a case against him in court to vacate the premises and request the overdue rent.

Dear Questioner,
According to UAE law, the landlord has the right to evict a tenant if they fail to pay rent or violate the terms of the tenancy contract.
In your case, since there is no registered Ejari with the previous owner, you will need to follow the following steps to evict the tenant and get the property registered under your name:
1. Serve a notice to the tenant:
The first step is to serve a notice to the tenant stating the reason for eviction and giving them a specific time period to vacate the property. This notice should be served through registered mail or through a notary public.
2. File a case with the Rental Dispute Settlement Center (RDSC):
If the tenant fails to vacate the property within the specified time period, you can file a case with the RDSC. You will need to provide all the necessary documents such as the tenancy contract, notice served to the tenant, and proof of non-payment of rent.
3. Attend the hearing:
The RDSC will schedule a hearing where both parties will be given a chance to present their case. If the tenant fails to attend the hearing, the RDSC may issue a judgment in your favor.
4. Obtain a court order:
If the RDSC issues a judgment in your favor, you will need to obtain a court order to evict the tenant. This can be done by submitting the RDSC judgment to the execution court.
Dear questioner,
Either you are required to file a complaint at the police station or the RDC for the eviction. Lack of Ejari and rent payment may be issues for the tenant in his legal claims.
Also, please check the sale-purchase agreement for the terms with your seller of the apartment regarding the lease terms and liabilities of the previous owner.
If he is responsible, you can also sue him for the losses and damages.

Dear Questioner,
Thank you for reaching out to me regarding your recent property purchase and the tenant's non-payment of rent issue.
I understand the importance of promptly addressing this matter to ensure the smooth operation of your investment.
In situations like yours, where there is no registered Ejari with the previous owner, the eviction process may require specific steps to be taken to ensure compliance with the applicable laws and regulations in Dubai.
Firstly, it's essential to review the tenancy agreement, if available, to understand the terms and conditions agreed upon between the previous owner and the tenant.
This document may outline the procedure for handling non-payment of rent and the rights and obligations of both parties.
Next, I recommend initiating communication with the tenant to attempt an amicable resolution. This could involve sending a formal notice requesting payment of overdue rent and providing a reasonable timeframe for compliance.
Keeping records of all communication is crucial for documentation purposes.
If the tenant fails to respond or comply with the notice, the next step would typically involve filing a case with the Dubai Rental Dispute Settlement Centre (RDC).
This involves submitting the necessary documents, including evidence of non-payment and any relevant correspondence with the tenant.
Throughout this process, it's essential to adhere to the legal requirements and procedures to avoid any potential complications or delays.
As your attorney, I can provide you with comprehensive guidance and representation to navigate the eviction process effectively.
