Denying labor dues upon resignation and demanding visa charges

Dear Sir/Madam,

My employer signed an offer letter from a different company, adding a clause stating that if the employee resigns, he needs to give one month's notice and refund AED 5000 as visa charges.

However, I have already signed a contract from another company and received my EID, with no such clause mentioned.

Now that I resign by giving one month's notice, my employer has not paid any salary or benefits even after completing one year and three months.

Additionally, they are demanding AED 5000.

Please advise!

Dear Sir/Madam,

If the worker resigns and there is a penalty clause, the new sponsor will bear the expenses.

In the aspect of not giving your salaries, you have to file a complaint with the Ministry of Human Resources and Emiratisation to claim your financial dues.

An employer cannot impose any financial penalties on an employee for resigning from their job.

Dear Questioner,

Article (6) clause (4) of the labor law states that the employer is prohibited from charging the worker for the fees and costs of recruitment and employment or collecting them from him, whether directly or indirectly.
