Can we nullify the MoU if the property isn't vacated by a specific date?
Dear Sir/Madam,
I am interested in buying a property that is currently tenanted. The agent has insisted that the tenant will vacate the property in two months; however, the current owner has not served any notice to the tenant.
Is there an agreement we can ask the tenant to sign before we agree to buy the property, such as an undertaking in front of a magistrate?
Can we include this in the MoU so that if the property is not vacated by a certain date, the MoU stands nullified?
Dear Questioner,
The tenant is not a party to the contract of sale, so forget about the tenant. The current owner can send him an e-mail and ask him to evict, and if he expressly agrees, in clear words, he is obliged to evict.
As for the contract of sale, you can stipulate the eviction of the tenant, and if the current owner cannot evict the tenant, then you have the right to demand the termination of the contract.

Dear Questioner,
There are certain things involved in this transaction.
Even though the tenant confirmed that he will be leaving the apartment on a particular date, he can deviate from the promise and can ask for a proper eviction notice.
If you want some rigidity, then you may get into the agreement with the tenant and that must be included in the MOU as well.
If you need further clarification, we will arrange a legal consultation session.

Hello
It is true that you thought about buying a property, as it is a successful investment.
The current tenant has the right to complete the period mentioned in the lease contract unless he willingly agrees to vacate the rented unit.
Please send the papers for review so that we can obtain legal advice before signing any contract.
This can be mentioned in the memorandum of understanding so that your position is correct

Dear Questioner,
For evicting the tenant from the property, an eviction notice should be sent to them 12 months before the date of eviction through a public notary or registered mail.
The tenant's rights persist even when there's a change in the landlord. Make sure that the eviction notice is properly served.
Dear Client,
Thanks for your question! I hope you are doing well. I will assist you in this matter.
In the UAE, you can request a written undertaking from the tenant to vacate the property within a specified timeframe.
You may include a condition in the Memorandum of Understanding (MoU) stating that the transaction is contingent upon the tenant's timely vacation.

Yes, you can sign the contract.
If the tenant doesn't vacate, the contract will be automatically terminated.
This should be mentioned in the contract.
