Q: Dear Sir/Madam, I sent my tenant in Dubai a rent increase notice before the 90-day period required by RERA. The RERA rent calculator does not allow any rent increase in this case, but I requested a Rental Valuation Certificate from the Dubai Land Department, which showed a rent increase. According to the law, which one will the Rent and Dispute Center follow?

Q: Hi, I was trying to check the RERA/rental increase for JVC. According to the rental index results, it stated that it is not applicable to hotels and hotel apartments. What is applicable for such residential complexes, and how can I calculate it? Additionally, where is it specified that the landlord needs to give 90 days' notice in case of a rent increase?

Q: Dear All, My rent renewal is due in April 2023 and currently paying AED 143000. The RERA Rental Index calculation shows an increase of 10%. The landlord sent a letter (90 days prior) along with a DLD valuation certificate attached stating that the rent will be increased to AED 220,000 (a 50%+ increase) based on the assessment of the property. Are there any options available to be able to contest this sizeable increase? (RDC will state that the landlord can use the valuation certificate to increase the rent now). تخضع العلاقة بين المستأجرين ومالكي العقارات في دبي للقانون رقم 33 لعام 2008 بشأن العلاقة بين مالكي ومستأجري العقارات في إمارة دبي. تتم إحالة منازعات الإيجار الناتجة إلى مركز فض المنازعات الإيجارية ("RDSC") الذي تم إنشاؤه بموجب المرسوم رقم 26 لعام 2013 للتوفيق بين الأطراف والوصول إلى حل ودي أو طلب إصدار حكم نهائي وإنفاذه من خلال مركز فض المنازعات الإيجارية.

Provisions of this Law supersede articles (2), (3), (4), (9), (13), (14), (15), (25), (26), (29), and (36) of Law No. (26) of 2007 Regulating the Relationship between Landlords and Tenants in the Emirate of Dubai. 

This Decree determines the maximum percentage of rent increase for real property in the Emirate of Dubai when renewing lease contracts.

The provisions of this Law apply to real property leased out in the Emirate of Dubai, including vacant and agricultural lands, but excluding hotel establishments and real property provided by natural or legal persons as accommodation to their employees at no charge.
